]22 <br /> <br />TUESDAY, AUGUST 9, 1994 <br /> <br />second reading, the following Ordinance No. 94-7: <br /> <br />BE IT ORDAINED by the'Council of the City of Martinsville, Virginia, in <br />regular session assembled, August 9, 1994, that it does hereby amend <br />the .City Code, Appendix B--Zoning Ordinance, Section XVI--Board of <br />Zoning Appeals, as follows: <br /> <br />A. Re-established; Composition; Appointment and Term of Members. <br /> <br /> The Board of Zoning Appeals is hereby re-established. It shall <br />consist of five (5) members, who shall be residents of the City, and <br />who shall be appointed by City Council. Members of the Board shall be <br />appointed for three (3) year terms, except that the original <br />appointments shall be made for such terms that the term of one (1) <br />member shall expire each year. Members may be appointed to succeed <br />themselves. The membership of the Board as constituted on the day <br />prior to the effective date of this ordinance shall continue in office <br />and be the membership of the Board under this ordinance for the <br />remainder of their originally appointed terms. A member whose term <br />expires shall continue to serve until his successor is appointed and <br />qualifies. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted the <br />following Ordinance No. 94-8: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled, August 9, 1994, that it does hereby amend <br />the City Code, Chapter 13--Offenses-Miscellaneous, Article I--In <br />General, Section 13-11.--Excessive, Unnecessary, Etc., Noise, <br />Subsection (a)(2), as follows: <br /> <br />Section 13-11. Excessive, unnecessary, etc., noise. <br /> <br />(a) <br /> <br />It shall be unlawful and a Class 1 misdemeanor for any <br />person: <br /> <br />(2) <br /> <br />To use, operate or play, in the city, any radio, television, <br />record or tape player, phonograph, musical instrument, <br />loudspeaker, sound amplifier or other machine or device <br />capable of producing or reproducing sound, which can be heard <br />inside the confines of an individual dwelling unit, house or <br />apartment of another person. Upon complaint being made to <br />any police officer that the provisions of this section are <br />being violated, such police officer may, after investigation, <br />give notice of such complaint to the owner or person in <br />charge of such residence and order the discontinuance of the <br />disturbance. Any person failing to comply with such order <br />shall be guilty of a Class 1 misdemeanor. <br /> <br />Council considered adoption, on an emergency basis, of Ordinance No. <br />94-9 approving the abandonment of a 20-foot alley located on the south <br /> <br /> <br />
