TUESDAY, JUNS 14, 1994 <br /> <br />noted that, according to the CODE OF VIRGINIA, no appointments would be <br /> <br />made until Council's meeting of June 28, 1994. <br /> <br />Council conducted a public hearing on a proposed amendment to Section <br />VI--Nonconformity, Paragraph J--Nonconforming Uses Involving the <br />Transportation or Temporary Storage of Hazardous Waste, of the City's <br />Zoning Ordinance. Those speaking on behalf of this amendment during <br />the Public Hearing were: Rev. Jimmie R. Hawkins of 408 Second Street <br />and Malvester X. Dixon of 217A Fayette Street. There being no one else <br />to speak, the Mayor declared the Public Hearing closed. Upon motion, <br />duly seconded, and by unanimous vote, Council adopted Ordinance No. 94- <br />5 on an emergency basis, as follows: <br /> <br /> BE IT ORDAINED by the Council of the City of Martinsville, <br /> Virginia, in regular session assembled June 14, 1994, that it <br /> does hereby amend the City Code, Appendix B--Zoning Ordinance, <br /> Section VI--Nonconformity, Paragraph J--Nonconforming Uses <br /> Involving the Transportation or Temporary Storage of Hazardous <br /> Waste, as follows: <br /> <br /> Section VI. Nonconformity. <br /> <br /> J. Nonconforming Uses Involving the Transportation <br /> or Temporary Storage of Hazardous Waste. <br /> <br /> A nonconforming use of land existing at the time of adoption <br /> of this ordinance, or any amendment thereto, may be terminated by <br /> the Council of the City of Martinsville after a reasonable period <br /> of time where such nonconforming use involves the transportation <br /> or temporary storage of any hazardous waste, as defined in Sec- <br /> tion 10.1-1400 of the 1950 Code of Virginia, as amended, if said <br /> Council finds that the transportation or temporary storage of any <br /> hazardous waste involved in the nonconforming use poses a clear <br /> and present threat to the health and safety of persons living or <br /> working adjacent to such nonconforming use. This paragraph shall <br /> expire on July 1, 1998. <br /> <br /> BE IT FURTHER ORDAINED that an emergency exists, therefore, this <br /> amendment will become effective immediately to conform with <br /> action by the 1994 General Assembly. <br /> <br />Following adoption of Ordinance No. 94-5, there was discussion as to <br />the next step to determine any nonconformity.
