TUESDAY, DECEMBER 12, 1995 order dated December 13, 1993, adopted the BOCA National Property Maintenance Code/1993, as Volume II of the Virginia Uniform Statewide Building Code, subject to certain exceptions set forth in Sections 101.2 and 101.3 of the Code adopted by said Board, which Code will sometimes hereinafter be referred to as the Building Maintenance Code; and WHEREAS, Section 101.1 of said Code provides that any local government may, after official action, enforce the Building Maintenance Code, or any portion thereof; and WHEREAS, it is the desire of the Martinsville City Council to enforce said Building Maintenance Code in its entirety, and to assign responsibility for enforcement of same to its Inspection Division as the "enforcing agency" and to the Building Official as the "Code official", NOW THEREFORE, BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular session held on December 12, 1995, that the Inspection Division of the City of Martinsville, Virginia, be, and it hereby is, designated as the enforcing agency of said Building Maintenance Code; and BE IT FURTHER ORDAINED that the Building Official of the City of Martinsville, be, and he hereby is, designated as the Code official for the enforcement of said Building Maintenance Code; and BE IT FURTHER ORDAINED that the City of Martinsville Board of Appeals be, and it hereby is, designated as the local Board of Building Code Appeals to hear appeals as authorized in said Building Maintenance Code and, BE IT FURTHER ORDAINED, pursuant to the provisions of Sec. 36-106B of the 1950 Code of Virginia, as amended, that in lieu of criminal sanctions for violations of specific provisions of said Code, that such violations shall subject the person or persons responsible to civil penalties for said violations of specified provisions of said Code which are not abated or remedied promptly after receipt of notice of violation from the Code official, as shown on the following schedule, subject to the deletions and amendments set forth in Addendum 1, Amendments to the BOCA National Property Maintenance Code/1993, as follows: Section Amount First Violation Additional Violations USBC Vol. II, Chapter 3 USBC Vol. II, Chapter 4 USBC Vol. II, Chapter 5 USBC Vol. II, Chapter 6 USBC Vol. II, Chapter 7 $25.00 $25.00 25.00 25.00 25.00 25.00 50.00 50.00 50.00 100.00 BE IT FURTHER ORDAINED that each day during which the violation is found to have existed shall constitute a separate offense except that specified violations arising from the same operative set of facts shall not be charged more frequently than once in any ten-day period, and a series of specified violations arising from the same operative set of
