126 <br /> <br />TUESDAY, AUGUST 11, 1998 <br /> <br />WHEREAS, in order to accomplish the purposes of said project it is necessary for the Martinsville <br />Redevelopment and Housing Authority to acquire fee simple title to a lot or parcel of land owned <br />by William W. Bennett and Karen J. Bennett in the City of Martinsville, Virginia, located at 119 <br />Moss Street, Martinsville, Virginia; and <br /> <br />WHEREAS, pursuant to authority previously granted, agents of the Authority have previously <br />made a bona fide but ineffectual effort to purchase said land from William W. Bennett and Karen <br />J. Bennett, but were unable to do so because of inability to agree upon the purchase price; and <br /> <br />WHEREAS, it is necessary to bring a condemnation suit in which the question of fair and just <br />compensation for said land shall be determined, and in which suit proceedings may also be <br />brought pursuant to Section 25-46.8 of the Code of Virginia to acquire fee simple title to said land <br />prior to the determination and deposit of said award of just compensation; now, therefore, <br /> <br />BE IT RESOLVED by the Martinsville Redevelopment and Housing Authority at a duly called <br />meeting held on August 11, 1998, that David B. Worthy be, and he hereby is, authorized and <br />directed to bring and conduct a condemnation suit to determine fair and just compensation for said <br />land in the name of and on behalf of Martinsville Redevelopmerit and Housing Authority and/or <br />its members, and, as such attorney, to make oath to the condemnation petition, all in accord with <br />applicable federal statutes and regulations, and with statutes of this Commonwealth in such cases <br />made and provided; and <br /> <br />BE IT FURTHER RESOLVED that said attorney be, and he hereby is, authorized and directed at <br />any time at~er filing the condemnation proceeding and prior to the determination and deposit of <br />the award of just compensation, to do whatever is required by Section 25-46.8 of the Code of <br />Virginia, including, without limitation, having the City Treasurer pay into the Court for the benefit <br />of the owners of said land the amount of a good faith estimate of the value of the property, in order <br />for petitioner to have the right to enter on said land and construct its works or improvements <br />thereupon as described in its petition. <br /> <br />There being no further business to come before the Authority, upon motion, duly seconded, and <br />unanimous agreement, Chairman Crabtree declared the Authority's meeting adjourned. <br /> <br />~ce B.
