113
TUESDAY, JULY 28, 1998
Assembly Session. The first item was a request for Council to adopt the Piedmont Community Services FY

1998-99 Performance Contract. Mr. Tobin described this Contract as the controlling document regarding the
services to be rendered by his organization and the unit costs for these services, stating that the contract was
negotiated between the Community Services Board and the State Department of Mental Health. He stated

~', that the document reflected fundamental changes about to occur in MHMR and Substance Abuse treatment in
Virginia, with the 'theme being a shift from services provided in State Hospitals and other service centers to
services provided at the local level. As a result of this shift Service Boards were to have a highly accountable
relationship with local government councils and boards. Vice-Mayor Teague and Council Member Haskell
expressed concern that this change would represent a shifting of cost for such services to the local level
without the necessary funding from the State to carry the services, constituting unfunded mandates. Mr.
Tobin agreed that this might occur, and that a greater burden would be placed on the families of their clients
as well. Council Member Haskell stated the importance of tracking the actions of the Governor' s
Commission on these services, due the potential for local funding requirements. Vice-Mayor Teague asked
what the consequences might be if Council did not adopt the Performance Contract proposed. Mr. Tobin
replied that services would continue to be rendered and that the Board would probably be engaged in a
contract with the State Department in any event. He also stated that in the future such refusal may result in
loss of funding for local programs. Mayor Crabtree observed that a clause in the contract stated that if it was
not adopted by September 15 of the current year it would go into effect on that date automatically. Council
Member Haskell asked how set the numbers in the Contract were, and was told by Mr. Tobin that they were

/---, subject to change according to a revision process in place, and that such changes need not be brought back for
Council' s approval. Upon motion duly seconded and by unanimous vote Council adopted the Piedmont
Community Services Contract as presented, and adopted a Resolution designating the Piedmont Community
Services Board as an Operating Board. This Resolution read as follows:

RESOLUTION
