ORDINANCE NO. 97-15 <br /> <br />TUESDAY, AUGUST 26, 1997 <br /> <br />BE IT ORDAINlED by the Council of the City of Martinsville, Virginia, in regular session assembled August <br />26, 1997, that it does hereby amend Subsection (a)(6) of Section 13-11--Excessive, Unnecessary, etc., Noise, <br />Article I--In General, Chapter 13--Offenses--Miscellaneous, oft he City Code as follows: <br /> <br />Sec. 13-11. Excessive, Unnecessary, etc., Noise. <br /> <br />(a) It shall be unlawful and a Class 1 misdemeanor for any person: <br /> <br />(6) <br /> <br />To emit, from any loudspeaker or sound amplification equipment located in or on any open or closed <br />vehicle, trailer, air-plane, balloon, or boat any advertisement, commercial message, music, speech, or <br />noise which can be heard by the unaided human ear at a distance greater than thrc~ (3) thirty. (30) feet <br />away from such vehicle, trailer, airplane, balloon or boat. <br /> <br />BE IT FURTHER ORDAINED by said Council that an emergency exists, and this Ordinance shall take effect <br />immediately upon adoption. <br /> <br />Council next considered a request for authorization for the City Manager to submit the City' s amended <br />Community Based Corrections Plan for the construction of a new jail facility to the Virginia Department of <br />Corrections. City Manager Reynolds provided a description of the process by which revised population <br />projections had been obtained, and the process by which the information requested by the Department of <br />Corrections would be submitted and reviewed. He stated that the good news was that if D.O.C. accepts these <br />findings, they will, in all likelihood, support sharing the costs of a 267 bed facility. He emphasized, <br />however, that it was certainly not the intent, at this point, to build a facility this large. Mr. Reynolds stated <br />that it is the City's intent to create programs and alternatives which will allow the City to address its needs <br />with a jail of 160 beds, with a possible additional 48 beds as an add alternate in the construction bid process. <br />Mr. Tom Rappe, of Strollo Architects, reviewed the work that had been done for D.O.C. to this point, and <br />explained the primary areas of change in the document, which were related to inclusion of 1996 jail <br />population figures, and specific projection models. Mr. Rappe also discussed critical measures to be taken to <br />keep jail population figures at a minimum in the future. Following discussion and questions by Council about <br /> <br /> <br />
