<br />WHEREAS, taxes on the hereinafter described real estate have not been paid since June of 1994; and
<br />
<br />WHEREAS, §58.1-3965 of the Code of Virginia provides that when any taxes on real estate in a city are
<br />delinquent on December 31 following the second anniversary of the date on which such taxes have become
<br />due that such real estate may be sold for the purpose of collecting all delinquent taxes on said property; now,
<br />therefore,

<br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular session held on October
<br />27, 1998 that the City Attomey be, and he hereby is, authorized and directed to file a bill in equity in the
<br />Circuit Court of the City of Martinsville within the time prescribed by law following the giving of the notices
<br />of said sale and the publication of same required by said §58.1-3965 to subject the hereinafter described real
<br />estate to the lien for such delinquent taxes, which real estate is described as follows:

<br />All of that certain tract or parcel of land, together with all improvements thereon and
<br />appurtenances thereunto appertaining, situated on the easterly side of Maple Street, on the
<br />westerly side of and at the end of Ellsworth Street, on the northerly side of the Norfolk &
<br />Southem Railway, and on the westerly side of Nox~otk and Southem Industrial Lead, City of
<br />Martinsville, Virginia, being known as Tract 17B1X containing 130,009 square feet, more or
<br />less, as more particularly shown on plat of survey for L & H Enterprises of Virginia, Inc.,
<br />prepared by Terry A. Waller, L.L.S., dated March 29, 1993, of record in the Clerk's Office of the
<br />Circuit Court of the City of Martinsville, in the then current Map Book being a recut of Tract
<br />17B 1 as shown on "Plat of Survey for American Furniture Company, Inc." of record in said
<br />Clerk's Office in Map Book 21, at pages 54, 55 and 56;

<br />TOGETH2ER with the right to joint use of the shaded access easements located on Tract 17B1X
<br />and the remainder of Tract 17B 1 (now designated as Tract 17B 1 Y) as shown on the aforesaid
<br />Plat of Survey for L & H Enterprises of Virginia, Inc. for ingress to and egress from the said
<br />Tract 17B1X; being the same land acquired by Veran Holding Corporation from L & H
<br />Enterprises of Virginia, Inc. by that certain deed dated April 9, 1993 and of record in said Clerk's
<br />Office in Deed Book 213 at page 750, to which deed and plats reference is hereby made for a
<br />more particular description of the land to be sold to satisfy the lien for such delinquent taxes.

<br />BE IT FURTHER RESOLVED, that the City Attomey be, and he hereby is, directed to report from
<br />time to time, to Council conceming the status of said suit once it has been filed.

<br /> There being no further business to come before Council during their regular meeting, upon motion
<br />duly seconded, by unanimous vote, Mayor Crabtree declared the meeting adjourned.
