3~ TUESDAY JUU 12, 19?5 The regular sem1-41lO~ meeting ot the Council of the CiV ot Martinsville, Virginia, with lda\for R. s. Hodnett presiding, was held in the Council Chamber, City Hall, on Tuesday, Ju:q- 12, 195.5, at 7:30 P.M., all members, as follows, being present: Mayor and Counc1JJnan R. S. Hodnett; and Coumilmen C. P. Craig, B. H. Hill, W. T. Turner, and J. R. Walker. Yinutes of the regular Council meeting held June 28, 19.55, upon being read, were appt"oved. The following report of the P4nningCommission was received am ordered placed on Council's next meeting's agenda: Honorable ~or and Cii:(y Council Oi t;y of lIartimvilJ.e llartin9ville, Virginia ~u ~~ 'i Gentlemen: The' PlanningCoDlllission of the City ot lIartinsv1lle, far the past several meetings, has been considering a petition .from the Honorable Ke:rman C. Whittle and Lanier Farms, Inc., requesting the rezoning of Lots 1 - 8, Section "JIt, of the Lanier Farms Developnent 1a.ying on the south side of Mulberry Road between Oakwood Court and Lanier Road, .from A-l ResidentiaJ. to B-1 Business in order that a neighborhood shopping center might be erected thereon. The Planning Commission, at its meeting on April 28, 19.55, voted unanimously to make the following recommendation toCit,. Council: That the property in question be rezoned as requested 'With the stipulation that certain restrictive covenants be presented to the Planning Commission for its approval, by the owners, and subsequentl\v recorded in the CiV Clerk's office. On June 2, 1955, the P1.aming Commission com idered a set ot covenants prepared by counsel for the petitioners and copy of these covenants as approved by the Planning Commission is attached hereto. The Planning Commission hereby recommends to Coureil that the property in question be rezoned as requested iZ"aVided the attached covenants are recorded in the Clerk's office to control the use of the property. The Pla.nn:i.ng COlIDIIission, in making the above recamrendatioD, is cognizant of the fact that our present zoning ordinance does not fully limit the use of land zoned tobusineas for the purpose as proposed in the petition submitted and cODSeque~ the covenants, as attached, have been recomrrended by the Commission and accepted by tM petitioners.
