Thomas Estate, Inc. <br />Martinsville, Virginia <br /> <br />Dear Mr. Gravely: <br /> <br />/~.....-- <br /> <br />Your letter of January 24, 1955 was presented to City CotIDci1 <br />at its regular meeting this past Tuesday night. The Council <br />understood from your letter that you were requesting the City <br />to lay at its expense an outfall sevIer line through the City <br />park in order that you would be able to provide sewer service <br />to the forty acres of land you propose to develop in that area. <br />Your letter seemed to indicate that you believed the City had <br />an unfulfilled obligation with respect to the deed of October <br />10, 1939 transferring the park property to City ownership. <br /> <br />Mz>; <br />i~ <br />'i <br /> <br />A careful study of the deed by Council together with a reviel' <br />of Council minutes relating to this transaction show that the <br />City has discharged all ob1i~ations, both real and implied, <br />lli th respect to the transfer of the property. T\vo present <br />members of Council were parties to the negotiation in 1939. <br />One actually carried on the negotiations and the other at that <br />time llas Clerk of Council. Both state that there llas no mention <br />of sewer or vreter mains in connection with the transaction and <br />the only agreement of the City lTaS to grade and pave the street. <br />This has been accomplished. <br /> <br />The cost of this nell project has been roughly estimated at <br />$1,500.00 and you advised that you would be able to draing some <br />35 lots through this proposed sewer outfall, \.rhich would mean <br />a pro-rate cost of approximately $45.00 per lot. Council agrees <br />that economics justify the proposed project; however the present <br />City policy does not provide for City participation in sm.lOr costs <br />until a street or development has 60% of the lots occupied by <br />houses or buildings. It is realized that this policy llould be <br />of nO value to you unless the houses are placed on the lots all <br />at one time as in a housing project. <br /> <br />Council is presently contemplating the advisibility of revlslllg <br />their subdivision street improvement policies ~~d it is possible <br />that a more liberal policy may be adopted.
