McGhee, Council referred these recommendations and proposed amendments to City Attorney stone for drafting into ordinance form. Council, next, accepted with sincere appreciation an offer from Mr. G. T. /- Lester, Sr. to donate or give to the CHy some fifteen (15) acres of land adjoining the City's impounding water reservoir property if the City would contribute $1,500.00 towards the construction of an access road to or near the said fifteen acres. Council instructed its Clerk to convey by letter his to Mr. Lester both Council's acceptance Of/generous offer and Council's appreciation. m- il ~ In order to obtain permits from the Virginia Department of Highways to construct, operate, and maintain certain public works over and along the State's highway system, Council adopted the following resolution, indemnifying the Commonwealth of Virginia against damages and claims arising out of said public works: .' WHEREAS, it becomes necessary from time to time for the City of Martinsville to obtain permits from the Virginia Department of Highways to install, construct, reconstruct, maintain, and operate certain public works along, across, over and upon the highway system of Virginia; and \iHEREAS, expen se, damage or injury may be sustained by the COInr:lonwealth of Virginia growing out ot the granting to said City of Martinsville by the Virginia Deparunent of Highways of said permits for the work aforesaid; and W1~EAS, one of the conditions of such permit or permits is that the City of Martinsville shall indemnify the Commonwealth of Virginia against all damages and injuries to the highways and bridges and to persons or property lav~ully upon such highways.
