S. Hodnett presiding, was held in the Council Chamber, <br /> <br />City Hall, on Tuesday, November 23, 1954, at 7:30 P.M., all members, as follows, <br /> <br />being present: Hayor and Council1na.n R. S. Hodnett; and Councilmen C. P. Craig, <br /> <br />B. H. Hill,W. T. Turner, and J. R. vlalker. <br /> <br />-~ <br /> <br />Minutes of the regular Council meeting held November 9, 1954, upon being read, <br /> <br />were approved. <br /> <br />In connection with its continuinG consideration of Hr. H. M. Turner's recent <br /> <br />request, through his counsel (Ycr-. J. English Ford, Attorney-at-Law), for a <br /> <br />refund of local business license taxes over-paid, and upon receipt from <br /> <br />~'" <br />i~ <br />v> <br /> <br />= <br /> <br />CorrillUssioner of the Revenue T. Jeff Eggleston of the following letter <br /> <br />recommending that the request be allowed, Council unanimously granted said <br /> <br />request and ordered the proper refund be made: <br /> <br />In regard to request for ref~d filed with you on November 9, 1954 <br />by J. English Ford, l'.ttorney-at-I,aw, for H. H. Turner (t/a Turner <br />and Mize Motor Co.), I wish to advise I have checked this request <br />and find the statements and figures to be true and correct according <br />to my records. <br /> <br />.,- <br /> <br />I, therefore, recommend to City Council this refund be granted, <br />basing my recommendation on the Second Paragraph of Section <br />Five (5) of the City License Tax Ordinance which reads as follows: <br /> <br />.- <br /> <br />nWhe~ever a license tax is assessed on the basis of <br />estimated gross receipts every erroneous estimate <br />thereof shall be subject to correction and the <br />Commissioner of the Revenue shall assess such person <br />with any additional license tax found to be true <br />after the close of the license year or the Corr~ssioner <br />of Revenue shall recommend to the Council of the Cit,y <br />of Martinsville the refunding of the amount of any <br />excess payment." <br /> <br />and Section Twenty-one (21) which reads in part as follows: <br /> <br />"As to all questions in regard to the duty and <br />conduct of officers of the City in collecting and <br />enforcing the taxes herein imposed, and in regard <br />to questions of construction, and for definitions <br />
