<br />WHEREAS it is the mutual des ire of the City of Mc1.rtinsville and the
<br />Appalachian Electric Power Compazw, in order to accomplish the above-
<br />rr:entioned purposes, to enter into an agreement setting forth, among
<br />other details, the location of a new substation to be constructed
<br />within the corporate limits of said City of Martimvill.e by the
<br />Appalachian Electric Power Company as well as certain rights-of-way
<br />granted by said City to said Appalachian Electric Power Company; now,
<br />therefore,

<br />BE IT RESOLVED by the Council of the City of Martinsvil1e, Virginia,
<br />in regular meeting assembled this twenty-eighth day of July, 1953,
<br />that it doth herein and hereby authorize its City !~anager, Kent
<br />Mathewson, to execute on behalf of the City of Martinsville an
<br />agreement between said City of Martinsville and the Appalachian
<br />Electric Power Company for the purposes hereinabove nentioned, which
<br />agreement is dated August 1, 1953.

<br />THIS AGREE?EENT, made this first da:y of August, 19~3, by and between
<br />the City of Martinsville, Virginia, a Municipal Corporation, hereilli~fter
<br />called City, party of the first part, and the Appalachian Electric Power
<br />Company, hereinafter called the Company, party of the second part:

<br />WITNESSETH: YfBEREAS it is the desire of the City and the Company
<br />tha,t the Company supplement the electric power that it is now providing
<br />to the City and also to provide two sources of supply ani,
<br />
<br />WHEREAS in order to accomplish this the Compan;y~ has purchased a
<br />substation site of 8.29 acres of land located approxilTlC'ctely wOO feet
<br />Northwest of U. S. Highway #57 (Chatham Road) in the City of
<br />Martinsvil1e, Virginia, and through which runs the Company's 132 KV
<br />Fieldale-Danville Transmission Line and,
<br />
<br />WHl."'REAS it is the intention of the Comparw to construct a 132/33 KV
<br />substation on this site and construct a 33 r::v LinG from the new station
<br />to the Company's ~,1orris Novelty Station where electric energy will be
<br />metered and c1.elivered to the City's 33 KV systen. HovfCver, the Company
<br />cannot proceed with the construction of the said 33 hV line to provide
<br />the service desired by the City until it has obtained from the City certain
<br />rights whi.ch 2!'e hereby granted by the City and wl1ich rights so granted by
