<br />1: <br /> <br />TUESDAY <br /> <br />JULY 14, 1953 <br /> <br />Upon recomnBndation of City Attorney Stone, Council adopted the following resolution <br /> <br />providing for the closinr, of an unopened alley on East Church Street Extension between <br /> <br />the properties of A. J. Evans and W. E. Mitchell, thus complying with the June 9, 1953, <br /> <br />request of the Ho~ Trinity Lutheran Church: <br /> <br />- <br /> <br />WHEREAS, under date of June 9, 1953 the Ho~ Trinity Lutheran Church of <br />Martinsville, Virginia, presented to the Council of the City of NJaI'tinsville, <br />Virginia a petition in which said Holy Trinity Lutheran Church requested the <br />closing of an unopened alley between the A.. J. Evans and W. E. Mitchell pro- <br />perties on the North side of East ChUrch Street Exter~ion; and <br /> <br />WHEREAS, Martinsville City Council, having du~ referred said petition to <br />the City's Planning COImnission, received under date of June 30, 1953 from said <br />Planning Commission a recommendation that said request be granted; and <br /> <br />WHEREAS, also under date of June 30, 19.53 in meeting assembled Martinsville <br />City Council accepted the Planning Commission's above-referred-to recoI:ll1lendation <br />and instructed its City Attorne~( to follow such legal procedure necessary to <br />effect the requested closing; and <br /> <br />~~ <br />~'i <br />~~ <br />i <br /> <br />WHEREAS, the City Attorney for the City of Martinsville has followed such <br />procedure and did so advise Martinsville CivJ Council in regular meeting <br />assen~led July 14, 19.53; now, therefore <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assenbled this fourteenth day of July, 1953 that it doth <br />herein order that said unopened alley be closed to a point extending 220.95 feet <br />from the Narth side of East Church Street Extension in accordance with map here- <br />inafter referred to; and <br /> <br />BE IT FURTHEJ:1. RESOLVED by Martinsville City Council in meeting of July 14, <br />195'3 that it doth herein request and instruct the Clerk of Martinsville City <br />Circuit Court to mark on his records as "vacated" said unopened alley far the <br />distance hereinabove mentioned in accordance with a map herein furnished said <br />Clerk, which map he shall record, as prepared by J. A. Trent, C.L.S., dated <br />July 2, 1953, which map is a map of property belonging to A. J. Evans et als, <br />legal reference for which is in Deed Book No.1, Page 369, of the Clerk's <br />office of Martinsville City Circuit Court. <br /> <br />No action was taken on a proposed right-of-way or easement contract with the <br /> <br />,..- <br /> <br />Appalachian Electric Povrer Company, this matter being deferred until a later date. <br /> <br />As requested by the Leacue of Virginia Municipalities, Council considered and indicated <br /> <br />its approval and/or disapproval of certain proposed state leGislation as prepared by <br /> <br />the legislative committee of the League. <br />
