That the City of Mlrtinsville pay to Henrj County, Virginia the <br />sum of $27,795.00 within five years from the 1st day of January, 1960p <br />this being in the judgment of the court a just proportion of the existing <br />indebtedness of Henry County. When such sum is paid to the County of Henry <br />it shall be applied to the payment of indebtedness of Henry County existing <br />as of the effective date of annexation; <br /> <br />6. This order of annexation shall be effective as of midnight December <br />31, 1959; and thereafter the residents of the annexed area shall be residents <br />of the City of Martinsville, with all rights, privileges and duties incident <br />thereto. <br /> <br />_. <br /> <br />7. That it is the majority opinion of this court that the City of <br />Martinsville, Virginia shall pay one-half the cost of this proceeding and <br />the qualified voters and freeholders petitioning for annexation herein <br />shall pay the remaining one-half. <br /> <br />This case is hereby retired from the docket of this court, subject to being <br />reinstated pursuant to provisions of Chapter 8, Article 1, Title 15, and any <br />other applicable provisions of the Code of Virginia of 1950, as amended. <br /> <br />Entered this 12th day of March, 1959. <br /> <br /> <br />Upon recommendation of City Manager Hirst, Council adopted the following resolution, <br /> <br />in which the local law firm of Taylor & Young was appointed to perform the legal <br /> <br />duties necessary for title search and deed preparation for the widening of Route 58, <br /> <br />or East Church Street, from Fairy Street east to Bob Gregory Street: <br /> <br />WHEREAS, the City of Martinsville is desirous of participating with <br />the State Department of Highways and the Federal Bureau of Public <br />Roads in a project known as Project No. 0059-120-070 designed to <br />widen Route 58 or Church Street from its intersection with Fairy <br />Street east to Bob Gregory Street in the City of Martinsville; and <br /> <br />WHEREAS, it will be the responsibility of the City to employ legal <br />counsel for title search ~~d deed preparation necessary to acquisition <br />of rights-of-way for this project; and <br /> <br />WHEREAS, the City of Martinsville does not maintain an organization <br />adequate for title search and acquiring right-of-way as a part of its <br />normal operating staff; now, therefore, <br /> <br />- <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-fourth day of March, 1959 <br />that the law firm of Taylor & Young, Martinsville, Virginia, qualified <br />attorney-at-law practicing in the City of Martinsville, is hereby <br />appointed to perform the legal duties necessary for title search and <br />deed prElparation for the aforementioned project. <br />
