<br />~48 <br /> <br />TUESDAY <br /> <br />AUGUST 12. 1958 <br /> <br />(2) In any B-1 and B-2 District, any building erected for the <br />purpose of residential occupancy, or which is erected after the <br />effective date of this amendment and is occupied for residential <br />purposes, shall be so situated on the lot or property on which it <br />is erected as to conform to setback, side yard and rear yard <br />requirements as provided for in A-1 and A-2 Residential Districts <br />as would be applicable to the type of building so erected. <br /> <br />All ordinance or portions thereof in conflict with these <br />amendments are hereby repealed. <br /> <br />An emergency existing, this ordinance shall be effective from date of passage. <br /> <br />Under date of August 12, 1958, the Planning CommiSSion advised that pursuant to <br />duly-advertised public notice it conducted on August 11, 1958 a public hearing on <br />Mr. Roy C. Stone's petition (referred by Council on July 22, 1958 to the Planning <br /> <br />Commission) requesting the rezoning from "A-1 Residential" to "B-1 Business" of <br /> <br />Mr. Stone's property not already so zoned, located near the intersection of Church <br /> <br />and Brookdale Streets. The Commission further advised that it recommends the <br /> <br />granting of the petitioner's request and, in addition, recommends similar rezoning <br /> <br />of property (one lot) owned by Nease, Wheeler, and Blackard, Inc., adjacent to the <br /> <br />Stone property. Council ordered that a duly-advertised public hearing on the <br /> <br />Planning Commission's reconnnendations be conducted at Council's next regular <br /> <br />meeting scheduled for August 26, 1958. <br /> <br />In connection with the Parking Committee's recommendations--portions of which <br /> <br />Council accepted on July 8, 1958 but on July 22, 1958 delayed the date on which <br /> <br />they were to become effective--Council asked City Manager Hirst to arrange a <br /> <br />special meeting at which the Council, members of the Parking Committee, and <br /> <br />downtown property owners and business firm representatives might discuss various <br /> <br />aspects of the recommendations and present their several viewpoints. <br /> <br />,- """", -."
