302 TUESDAY APRIL 22. 1958 City Manager Hirst also informed Council that, as a result o~ a recent canvass or survey, owners of property located just outside of the corporate limits on Cir'eyson Street have indicated that they are not agreeable to paying 100% of the cost of construction curb-and-gutter in front of their properties. Pending the receipt of additional information, Council continued its study of the City's business and occupational license tax structure. A special committee appointed b7 Council February 4, 1958 to study the application of Lester Brothers, Inc., for a water service connection to City mains for the purpose of serving as a fire supply service to the Lester plant, submitted the following recommendations which Council accepted and ordered that these recommendations constitute terms of a contract to be offered Lester Brothers: The committee, on the basis of its study, recommends to the Council that the city a1Tail itself to enter into a contract with Lester Brothers for the provision of standby fire water service with the general provisions that the firm would construct the line from the corporate limits to the plant; that if the line from the city to the plant was felt by the city to be desirable to be of a size larger than for +ester Brothers that the city assume the difference in expense for the larger main; that the line within the public right-of-way be deeded to the city upon completion of construction; that the firm construct such lines within its plant area and make such revisions to the system at its own expense as wrnAld be necessary in accordance with the requirements of the State Health Department, the Fire Underwriters, and the city to separate the fire system from the domestic system; that, if the water service is to be used for fire protection only, there be no charge for water furnished or requirement of metering except as the city at its own expense install a detector meter; that the firm make an annual payment to the city in the form of a water charge payment as of I-l'ay 1 of each year in the amount of 130t per $100 of gross sales of the firm for the previous reportable year with this payment being on an advanced basis and be levied on prior gross sales to cover fire protection water service for the forthComing year from Hay 1. Recommendation is fU~ther made that the Council, if the firm should so request, enter into a contract with the firm for the sale of domestic or industrial water supply to be sold at the prevailing rate outside of the corporate limits with all of the above provisions being applicable except that there would be the necessity of metering.
