<br />2: <br /> <br />TUESDAY <br /> <br />NOVEMBER 12, 1957 <br /> <br />The term applicant shall be the person, firm, corporation, subdivider, <br />developer or group of persons desiring the extension and in a position <br />to assume the responsibility and cost therefor. The information con- <br />tained in the application shall be adequate to thoroughly acquaint the <br />Council with the nature and features of the proposal. The application <br />shall state that the applicant is familiar with the provisions of this <br />section and will enter into a contract with the city accordingly. <br /> <br />(b) The city will consider the allowance of its water and/or sewer lines <br />to be extended beyond the corporate limits provided compliance with <br />the provisions of this and other related ordinances of the city is <br />secured. <br /> <br />/- <br /> <br />(c) Each extension shall require execution of a contract between the Council <br />and the applicant, which contract will set forth the conditions under <br />which the specific extension, or allowed portion thereof, will be cons- <br />tructed and used. Each extension be subject to individual consideration <br />by the Council. Each business or manufacturing operation desiril:g <br />connection to city water or sewer service outside the corporate limits <br />shall make individual application to the Courcil. <br /> <br />(d) The Council, may if circumstances indicate such action desirable, <br />require that parties other than, a.ni in addition to, the applicant be <br />made party to an applic a tion or contract. <br /> <br />~~Zi' <br />'.'.~..~ti <br /><.::.;: <br />ij <br /> <br />(e) The term extension, as used herein, includes the connection of existing <br />utility lines, outside the corporate limits, with the city system. <br /> <br />Section 2. New subdivisions and roadways not in state system. <br />Extension into areas as follows shall be subject to the requirements of <br />Section 3 below: <br /> <br />(a) Subdivisions made a matter of record in the Circuit Court CJerk's <br />office of Henry County after April 12, 1955, ani <br /> <br />(b) Streets "Whose right-of-ways have been dedicated or made public <br />thoroughfares prior to April 12, 1955, but which streets or right-of- <br />ways have not been accepted into the primary or secomary system of <br />the Virgin:l.a Department of Highways. <br /> <br />Section 3. Conditions specifically applicable to areas and streets of Section 2. <br />The following conditions will be met or agreed to before extensions can be <br />permitted into areas or streets specified in Section 2 above: <br /> <br />(a) Subdivisions under section 2 (al or property abutting streets under <br />section 2 (b) shall be platted in conformity with the requirements of <br />appropriate provisions of Section IV of the City Subdivision Ordinance. <br />The C oum il will refer plats of the property to the City Planning <br />Comnission for review and recomnendation to the Council. Construction <br />of the water and sewer lires will not be allowed until a final plat <br />which meets the design standards of Section VI of the City Subdivision <br />Ordinance s hall have been duly recorded. <br />
