Marginal access streets are minor streets which are parallel to and adjacent <br />to arterial streets and highways; and which provide access to abutting pro- <br />perties and protection from through traffic. <br /> <br />5. Alleys are minor ways which are used primarily for vehicular service access <br />to the back or the side of properties otherwise abutting on a street. <br /> <br />F. Street width shall be the total width of the strip of land dedicated or reserved for <br />public travel, including roadway, curb, gutters. sidewalks, and planting strips. <br /> <br />Q. The term subdivision means the division of a parcel of land into two (2) or more <br />lots or parcels for the purpose of transfer of ownership or building development, <br />or, if a new street is involved, any division of a parcel of land; provided that a <br />division of land for agricultural purposes into lots or parcels of five (5) acres or <br />more and not involving a new street shall not be deemed a subdivision. The term <br />includes resubdivision and, when appropriate to the context, shall relate to the <br />process of subdividing or to the land subdivided. <br /> <br />R. The term subdivider shall refer to an individual, corporation or registered partnf,r- <br />ship, owning any tract, lot. or parcel of land to be subdivided; a group of two or <br />more persons owning any tract. lot or parcel of land to be subdivided. who have <br />given their power of attorney to one of their group or to another individual to act in <br />their behalf in planning, negotiating for, in representing, or executing the purposes <br />of the subdivision. <br /> <br />SECTION III - ADMINISTRA TION <br /> <br />A. In accordance with Section 15 - 784 Code of Virginia, and unless otherwise provided <br />herein, the provisions of this ordinance shall be administered by the Planning <br />Commission acting for, and as agent of, the City Council and approval or disapFrc,r..,l <br />by the Commission shall constitute approval or disapproval as though it were given <br />by the City Council as the governing body. <br /> <br />B. The agent of the Commission shall perform such duties as regards subdivision and <br />subdividing as are designated by this ordinance. <br /> <br />SECTION IV - FROCEDURE <br /> <br />A. F re-application F rocedure <br /> <br />1. F revious to the filing of an application for conditional approval of the preliminary <br />plat the subdivider shall consult early with the agent of the Commission con- <br />cerning the subdivision plans of the subdivider. It is the intent of this require- <br />ment that the subdivider may familiarize himself with these regulations and that <br />the agent of the Commission and such personnel of the City as may be appropriate <br />and concerned shall be afforded by the subdivider opportunity to advis e and assist <br />the subdivider prior to the preparation of the preliminary plat and related <br />material. <br /> <br />- 3 - <br />
