<br />154 <br /> <br />M<lIDAY <br /> <br />MAY 20. 1957 <br /> <br />BE IT FURTHER ORDAINED that this amendment shall become effective <br />upon date of passage and shall apply in the computation of 1957 <br />property tax bills and shall remain in force until otherwise <br />changed. <br /> <br />AN ORDINANCE IMPOSING AND LEVYING A. MONTHLY TAX ON THE USERS OF <br />WATER AND ELECTRICITY WITHIN !HE CITY OF MARTINSVILLE EFFreTIVE <br />THE FIRST DAY OF JULY, 1957 AND CONTINUING IN EFFFI:T UNTIL <br />OTHERWISE CHANGED FOR THE SUPPORT OF THE CITY GOVERNMINT, THE <br />PAYMENT OF PRINCIPAL AND INTEREST ON THE CITY DEBT, AND FOR OTHER <br />MUNICIPAL PURPOSES, PROVIDING FOR THE COLLECTIONS OF SAID TAX <br />AND PROVIDING P>>1ALTIES. <br /> <br />BE IT ORDAINED BY THE CarNCIL OF THE CITY OF MARTINSVILLE <br /> <br />1. STATEMENT OF POLICY - It is the purpose and policy of the <br />Ci ty of Martinsville in enacting this ordinance imposing a tax <br />on the users of electricity and water within the City of <br />Martinsville to equalize, as far as practicable, the burden of <br />taxation among its citizens. <br /> <br />2. DEFINITIONS: The following words and phrases, when used in <br />this ordinance, shall for the purpose of this ordinance, have <br />the following respective meanings except where the context clearly <br />indicates a differenc meaning. <br /> <br />(a) The work "person" shall include indiViduals, firms, partnerships, <br />associations, Corporations, and combinations of individuals of whatever <br />form and character. <br /> <br />(b) UTILITY SERVICE: The phrase "utility service" shall include <br />electricity service and/or water service fUrnished by the City of <br />Martinsville within its corporate limits. <br /> <br />(c) PURCHASERS: The word "purchaser" shall include every purchaser <br />of electricity service and/or water service unless otherwise <br />specifically exempt by the City of Martinsville. <br /> <br />(d) The word SELLER: The word "seller" shall mean the municipality <br />of the City of Martinsville who sells and fUrnishes such utility <br />services. <br /> <br />J. There is hereby imposed and levied by the City of Martinsville <br />upon each and every purchaser of a utility service as defined in <br />Section 2 herein a monthly tax in the sum of One Dollar ($1.00) <br />against the purchaser with respect of utility service, which tax <br />in every case shall be collected by the seller from the purchaser <br />and shall be paid by the purchaser unto the seller for the use of <br />the City of Martinsville at the time that the purchase price or <br />such charge shall became due and payable under the agreement <br />between purChaser and seller. The fact that a purchaser shall <br />purchase both electricity and water from the seller shall not be <br />construed as imposing a tax on each utility service furnished by <br />the seller to the purChaser, that is to say, under this ordinance, <br />the maximum tax to be collected from a purchaser shall be one <br />dollar ($1.00) per month. <br />
