<br />50 <br /> <br />TUESDAY <br /> <br />MAY 14. 1957 <br /> <br />In response to a petition submitted by citizens residing on Standpipe Road, <br /> <br />requesting that their street name be changed, perferably to that of <br /> <br />"Bethel Lane", Council ordered a public hearing to be held at Council's <br /> <br />June 11th meeting on this request. <br /> <br />In response to both a written end verbal inquiry from Mrs. George E. <br /> <br />Spencer of Spencer Photo Studio, regarding out-of-state photographers <br /> <br />and the lack of license taxation on same, Council pointed out that, because <br /> <br />of interstate commerce provisions and in view of court decisions in <br /> <br />relevant cases, the City of Martinsville and ot~er licensing municipalities <br /> <br />are unable to tax such out-of-state photographers doing business in the <br /> <br />manner prescribed. Council, however, considered suggestions which were <br /> <br />referred to City Manager Hirst and which might afford and provide some <br /> <br />equity between local photographers and out-of-state photographers. <br /> <br />In connection with the City's plans to widen Fishel Street Extension and <br /> <br />to construct and maintain a six-inch cast iron water pipe line along this <br /> <br />street and across the right-of-way of the Carolina & Northwestern Railway <br /> <br />Company at a point of 130.5 feet southeast of Milepost 41, Council adopted <br /> <br />the following resolution authorizing Mayor Shultz to execute an agreement <br /> <br />on behalf of the City of Martinsville between the City and the Carolina & <br /> <br />Northwestern Railway Company covering that portion of the proposed water <br /> <br />line crossing the railway company's right-of-way: <br /> <br />WHEREAS the City of Martinsville desires to construct and maintain <br />a six-inch cast iron water pipe line along Fishel street Extension <br />along and across the right-of-way or property and under the main <br />track of the Carolina & Northwestern Railway Company at a point <br />130.5 feet southeast of Milepost 41; and <br /> <br />WHEREAS en agreement between the Carolina & Northwestern Railway <br />Company and the City of Martinsville, whereby the City of Martinsville <br />will be permitted to construct and maintain said water line, was <br />presented to and approved by Martinsville City Council during its <br />regular meeting held May 14, 1957; therefore, <br />
