<br />Whereas on the 26th day of February, 1957, the City Attorney stated to
<br />the Mayor and the Council of the City of Ma.rtinsville, Virginia, that it was
<br />necessary for the C oun:: il to consider condeJTI_'1ing a certain 40 foot right of
<br />way on the land or property belonging to Oscar Cleo Wilkins, Jr., heir of
<br />Jcmes L. Millner, deceased, in the City of Martinsville, Virginia, so that
<br />sufficient right of Vlay could be had to enable the Cii:?f to widen and extend
<br />Fishel Street, and 'which s aid parcel of real estate to be condemned is more
<br />particularly described as follows:

<br />B3GINNING at a point in the center line of Fishel Street having a 40
<br />feot right-of-way, said point located along the dividing line of property
<br />owned by Jamar R. Millner and Oscar Cleo Wilkins, Jr., an infant, and the
<br />sole heir at law of James L. Millner who died intestate, and being the same
<br />property acquired by the said James L. ;,~illner by deed from Charles Stultz
<br />and recorded in the Clerk's Office of Circuit Court of Henry County in
<br />ooed Book 42, page 115; thence leaving said point above mentioned and
<br />continuing along the center line of Fishel Street and running through the
<br />property of the above mentioned Oscar Cleo Wilkins, Jr., N. 560 18' w.
<br />278.94 feet to a point being the P. C. of curve to the left having a radius
<br />of 193.98 and a length of ]25.89 feet to a point in the right of way line
<br />of the Carolina & Northt"lestern Railway; thence S. 860 31' w. 46.26 feet to
<br />a point in the center line of the Carolina & Northwestern Railway and beine;
<br />S. 330 38' E. 188.65 feet from M. P. 41; the description of the above Street
<br />being a continuation of a Street known as Fishel Street, having a 40 foot
<br />:-ight of way and running through the property of James R. Millner as shown
<br />on a map prepared by W. C. Brown, Decenber 29, 1956, and recorded in the
<br />Clerk's Office, City of Martinsville, Virginia in J.Iap Book , page ,
<br />for a more particular description of the conveyed right of way through ~
<br />above mentioned Oscar Cleo Wilkins property by the C it~r of Martinsville a
<br />ffi8p is on file in the Clerk's Office, City of I.lart::.n5ville, Virginia in
<br />Map Book , page ; map having been pre!)ared by the Engineering
<br />Division of the City of LIartinsville, Virginia.

<br />The Cit:r Attorney t.l}en presented to the meeting a map entitled "Map
<br />shO\ving proposed right of way through property of J8mes L. Millner Estate
<br />loca ted adjacent to Carolina P,: Northwestern RaiJ_t'oad, near East corporate
<br />line, City of ~tartjnsville, Virginia."

<br />Thereupon the follo-:dng preamble and resolution were offered and duly
<br />adopted by unanimous consent of all the Council members present:

<br />for the CivJ of I':a,rt::nsville to have sufficient right of 'way to widen and
<br />extend Fishel Stl'(>3t, that it acquire additional right of v;ay, which is more
<br />particularly described as follows, to-wit:
