Access to the cottage will be way of a service road near the <br />tow of the dam and will not be through the road into the <br />general recreation area. Therefore, it would be possible to <br />close off the recreation facilities in the dam area without <br />prohibiting access to the cottage. <br /> <br />5. The Volunteer Fire Department cannot sell or lease the cottage <br />facility and upon completion of its construction it becomes <br />technically the property of the City. Should for any reason <br />the Volunteer organizstion terminate its occupancy for use <br />of the facility then the building and all related incidentals <br />thereto would fall to the City. Maintenance responsibility <br />of the cottage will be with the Volunteer Fire Department. <br /> <br />6. Prior to the completion of construction of the cottage, there <br />will be appointed by the Volunteer Fire Department a House <br />Rules Committee who will prepare a set of rules and regulations <br />governing the use of the cottage. These rules and regulations <br />will be approved by the membership of the Fire organization <br />and by the City Manager. Any amendments or revisions in the <br />rules must be approved by the Volunteer organization in accordance <br />with its general policy for action on such matters in accordance <br />with its by-laws and such amendments must have the approval of <br />the City Manager. It would be the responsibility of the House <br />Committee of the Volunteer organization to enforce or bring <br />about the enforcement of the regulations governing the use of <br />the cottage. <br /> <br />7. The cottage will be used for functional and entertainment affairs <br />of the Volunteer Fire Department. <br /> <br />It may also be used by individual volunteer firement; however, in <br />their individual use other facilities, certain restrictions as <br />to guests and extent of usage will be placed upon them by the <br />Rules Committee in accordance with paragraph 6 of above. The key <br />to the cottage will be maintained in the Fire Station and any <br />persons using it will sign in and out in order that at all times <br />it may be known who is availing themselves of the facility. <br /> <br />The cottage will be available upon receipt of each instance of <br />permission from the House Committee of the Fire Company to <br />other City groups provided they conform to regulations as <br />approved by the House Committee. It is the intent that the use <br />of the cottage would be prohibited to other individuals or groups <br />than stated above. <br /> <br />8. The City Attorney will be asked to prepare a memorandum of <br />agreement to the effect of the above which will be signed by the <br />officers of the Volunteer Fire Department and the City. The above <br />arrangements have been tentatively agreed on in joint City- <br />Volunteer Fire Company conference in an effort to establish a <br />cooperative policy on the project. The presentation of the above <br />in this form is not to infer that the set forth provisions are the <br />arbitrary iT'lpositions of the City as they are intended to be <br />formulated by mutual agreement. <br />
