14 TUESDA Y J1JNE 26. 1956 4. Access to the cottage will be way of a service road near the tow of the dam and will not be through the road into the general recreation area. Therefore, it would be possible to close off the recreation facilities in the dam area without prohibiting access to the cottage. 5. The Volunteer Fire Department cannot sell or lease the cottage facility and upon completion of its construction it becomes technically the property of the City. Should for any reason the Volunteer organizstion terminate its occupancy for use of the facility then the building and all related incidentals thereto would fall to the City. Maintenance responsibility of the cottage will be with the Volunteer Fire Department. 6. Prior to the completion of construction of the cottage, there will be appointed by the Volunteer Fire Department a House Rules Committee who will prepare a set of rules and regulations governing the use of the cottage. These rules and regulations will be approved by the membership of the Fire organization and by the City Manager. Any amendments or revisions in the rules must be approved by the Volunteer organization in accordance with its general policy for action on such matters in accordance with its by-laws and such amendments must have the approval of the City Manager. It would be the responsibility of the House Committee of the Volunteer organization to enforce or bring about the enforcement of the regulations governing the use of the cottage. 7. The cottage will be used for functional and entertainment affairs of the Volunteer Fire Department. It may also be used by individual volunteer firement; however, in their individual use other facilities, certain restrictions as to guests and extent of usage will be placed upon them by the Rules Committee in accordance with paragraph 6 of above. The key to the cottage will be maintained in the Fire Station and any persons using it will sign in and out in order that at all times it may be known who is availing themselves of the facility. The cottage will be available upon receipt of each instance of permission from the House Committee of the Fire Company to other City groups provided they conform to regulations as approved by the House Committee. It is the intent that the use of the cottage would be prohibited to other individuals or groups than stated above. 8. The City Attorney will be asked to prepare a memorandum of agreement to the effect of the above which will be signed by the officers of the Volunteer Fire Department and the City. The above arrangements have been tentatively agreed on in joint City- Volunteer Fire Company conference in an effort to establish a cooperative policy on the project. The presentation of the above in this form is not to infer that the set forth provisions are the arbitrary iT'lpositions of the City as they are intended to be formulated by mutual agreement.
