<br />J30 <br /> <br />TUESDA'{ <br /> <br />JillrE 27. 1 961 <br /> <br />As prepared by the City Attorney and pursuant to the request of the <br /> <br />Martinsville Council of Garden Clubs, Crnlncil adopted the follovdng ordinance <br /> <br />designating the entire City of }'~rtinsville as a Bird Sanctuary, providing <br /> <br />for the protection of desirable birds and wild fowl, and providing penalties <br /> <br />for the violation of this ordinance: <br /> <br />BE IT ORDAINED by the Council of the City of Hartinsvi 11e, Virginia, <br />in regular meeting assembled, as follows: <br /> <br />That the enti~e area within the corporate limits of the City of <br />Hartinsville be, and the same is hereby designated as, a Bird <br />Sanctuary; that it shall be unlawful to trao, hunt, shoot or <br />attempt to shoot or molest in any manner any bird or wild fowl <br />or to rob bird nests or wild fowl nests; provided, however, if <br />any such birds are found to be congregating in such numbers in a <br />particular area so as to constitute a nuisance or menace to health <br />or oroperty in the opinion of the Health Department or the Department <br />of Police, then such birds may be destroyed in such numbers and in <br />such manner as is deemed advisable, by direction or under supervision <br />of the Chief of Police of said City. <br /> <br />A.nyone convicted of violating the provisions of this ordinance shall <br />be punished by a fine of not more than $100.00 or by imprisonment <br />not exceeding thirty days. <br /> <br />By unanimous action, Council appointed 111:'. Frank I. Richardson, Jr., to membership <br /> <br />on the City School Board for a three-year term beginning July 1, 1961. <br /> <br />Mr. C. H. Scearce, of 1108 Chatham Heights, appeared before Council and <br /> <br />reiterated his claim--previously presented to Council--that he is entitled to <br /> <br />compensation for alleged damages to his property as a result of the widening <br /> <br />and imDroving of Cr~tham Road; Mr. Scearce, however, also stated his willingness <br /> <br />to accept the City's assistance in the manner heretofore offered; whereupon, <br /> <br />Council continued the matter for further consideration with the expressed <br /> <br />intent of advising Mr. Scearce of its decision within the immediate future. <br />
