<br />Section 3. Territorial Area Involved. The franchise related to the
<br />present territorial limits of the city, and to any area henceforth added
<br />to the territorial limits of the city during the term of this fra?1chise.
<br />
<br />Section 4. Service Standards. The grantee agrees to provide and
<br />maintain, at all times, its entire plant, system, and equipment, including
<br />customer equipment, in such condition that it will furnish safe, adequate,
<br />effident and continuous service to the citizens of the city.

<br />Section 5. Use of Streets.

<br />Subsection a. General Contr~Land Locatjpn of Lines and Conduit.
<br />The grantee, in any opening it shan make in the stre0ts in the city, shall
<br />be subject to the provisions of this franchise and to all applicable
<br />ordinances and regulations. An poles erected by the grantee shall be
<br />neat and symmetrical and shall be so located as to in nl") "\-ray interfere
<br />with the safety or convenience of uersons traveling on or over the streets
<br />and public places. The city reserves the right by resolution or otherwise
<br />to ft~ther or specifically designate t~e locations of any poles, towers,
<br />lines, cable or conduit, with reference to other municipal facilities
<br />such as sewer ane water mains, electric poles and lines and other services,
<br />or to other facilities such as gas lines and public electric utilities, in
<br />such a manner as to uromote the public safety and to protect public prouerty.
<br />Failure by the city to so designate shall not relieve the grantee of
<br />responsibility in matters of public safety. The grantee shall const~uct
<br />and locate poles, lines and conduit as not to interfere with the construction,
<br />location, and maintenance of sewer or 'Water service lines or mains. Any
<br />designation of location required or authorized herein shall be accomplished
<br />by the city so as not to unnecessarily delay the grantee in any of its
<br />operations.

<br />Subsection b. Disturbance of Streets - Restoration.
<br />
<br />(1) The city council may requirn that written permits, in any or all
<br />cases, be obtained by the grantee from the director of public vrorl:s of the
<br />city before and whenever it becomes necessary for the grantee to ~Lcavate in
<br />the streets of the city in order to install, construct, extend, or repair any
<br />of the telephone lines, poles, towers or conduit or seryices therein or thereon.
<br />Such permits, if required, may be apnlicable to any or aU types of excavations
<br />as prescribed by the city council. Such permits, further, shall state the
<br />particular part or point of the streets where said construction or excavation
<br />is to be made and the length of tiIne in which such permit shall authorize such
<br />work to be done. Exception to requirement for permit s11.'111 be permitted in
<br />cases of emergencies involving public safety.

<br />(2) Imnediately after poles, to'....ers, conduit, lines, manholes are
<br />installed or repaired, by the grantee to this ordinance, the incidental trenches
<br />or excavations shall be refilled by the grantee in a manner acceptable to the
<br />director of publiC works. Paver:ent, sidCl.J'a1ks, curbs, gutters, or other portions
<br />of streets or public places destroyed, disturbed or da.,'lla.ged by such work shall
<br />be promptly restored ano repJ_aced with l:1.1ce materials to their former condition
<br />by the grantee at its own expense; however, where it is np~~ssary, and if
<br />permitted, in order to achieve former condition to use materials \.[hose type,
<br />specifications or quantities exceed or are djf:~erent than those used in the
