J04

TUES DA Y

MAY 9, 1961

proposal effected, we will be forced to reconsider the effect that
comtruction of the proposed sewer lire will have upon our improvemmts
if and when the City of Martinsville is prepared to proceed with the
comtruction of this proposed sewer line project.

When Forest Park Country Club, Incorporated was first contacted over
a year ago about this proposed project we i nforIOOd the City of Martinsville
that we were in the process of expending a large sum of money on the
construction of rew facilities in this area and would be anxious to have
this sewer construction projec t completed as soon as possible in order
that the City of Martinsville might save as much as possible by not having
to destroy the capital improvements that we proposed to make to our
property. We regret that the City of Martinsvil1e has continued its
delay of this sewer lire project, arrl that we have to proceed with our
capital improvement program, thereby making it necessary for us again to
re-eval uate the damage which will occur if and when the C i tor of M3.rtinsvil1e
shall undertake their proposed sewer line construction.

Yours very sincerely,

sf W. T. Tur reI', Pres ident

Dr. C. D. Myers, Chairman of the Martinsville Library Board of Trustees, appeared

before Council and presented the Trustees' outline for the improvement and deve1op-

ment of the local public library as an educational service to the cOIIDIlunity, the
presentation emphasizing two phases of development, viz., (1) present objectives
and (2) long-range objectives.

In further comidering the petition submitted April 25, 1961, by Mr. Janes B. Jores,

Jr., in which was requested the vacation of a small triangular tract of City-owned

land located near Cheshire street and Memorial Boulevard, as well as the abandoning

of a portion of Cheshire Street, Council determined that the City will not vacate

the property in question but, in holding title to the property and considering this

property as highway ri~t-of-way, might give right of i~ress and egress, contingent

upon Council's action relative to the requested abandoning of the portion of

Cheshire Street. Council then agreed to consider too requested abandoning of the
portion of Cheshire Street through the appointment of a Board of Viewers (composed
of Mr. R. A. Henderson, Sr., Chairman; Mr. A. W. Smith; and Mr. Aubrey H. Patterson)
to perform the duties as prescribed in Section 15-766 of the Code of Virginia, 1950,

and as amended.
