<br />superseding resolu.tions of similar intent adopted by Council on August 23, 1960:
<br />
<br />WHEREAS, Marvin L. Hill, duly appointed Right-of-way Negotiator for the
<br />city of Martirnville, the Commonwealth of Virginia, and the Federal
<br />Governmerrt, in connection with the improving and widening of U. S. Route
<br />58 and Virginia Route 57 within the corporate limits of the City of
<br />Martinsville, has advised the Council of the City of Martins vi lIe that
<br />he has exhausted all available means wi thin the limitations of his autho-
<br />rity , without success, towards purchasing the fee simple title to that
<br />certain parcel of land O1med by Ida L. Prillaman and known and described
<br />as Parcel No. 022 as right-of-way for the aforementioned corntruction
<br />project;
<br />
<br />WHEREAS, said s trip or parcel of land is necessary for the construction,
<br />re-construction, alteration, and maintenance of said street; now,
<br />therefore,
<br />
<br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in
<br />regular meeting held December 13, 1960, that on behalf of the governments
<br />hereinabove mentioned Irvin W. Cubine, an attorney at law, be and is hereby
<br />appointed attorney and agent with authorization to institute and conduct
<br />condemnation proceedin~s to acquire said land in fee simple, together with
<br />necessary easements, and as its attorney to make oath to the petition, all
<br />in accord with the statutes in this State am the provisions of the Charter
<br />of the City of Martinsville, Virginia, in such cases made and provided.
