<br />~46 <br /> <br />TUESDAY <br />-A <br /> <br />DEX:: E/,1BER D, 1960 <br /> <br />Engineers, and as more specifically shown on detailed construction plans, <br />prepared by said Consulting Engineers, and on file in the Engineeri~ <br />Division of the City; and, said program does include extension of sewer <br />lines to unserved areas of the City including the area hereinbelow <br />described in this contract; and, <br /> <br />WHEREAS, Lanier Farms desires to have constructed, at this time, a sewer <br />line, which line shall c crnmence on Indian Trail at a point near the <br />intersection of Windsor Lane with Indian Trail, connecting said point <br />to an existing sewer line, thence proceeding generally northward and <br />parallel to Indian Trail to a point on Spruce Street, all within the <br />City of Martinsville; and which is designated as line 3-10 in said plans, <br />excepting that portion of line 3-10 already corntructed prior hereto south <br />of Windsor Lane; and, <br /> <br />WHEREAS, line 3-10 is not scheduled for construction in the improvement <br />program of the City at this immediate time but is scheduled for construction <br />at a later date in the seven-year progr'am in accordance with the arrangement <br />far- corntruction of all lines in the City; and, <br /> <br />WHEREAS, the local contracting firms of Prillaman & Pace, Incar-porated, and <br />J. V. Richardson Car-p., have, by formal quotation to the City, agreed to <br />construct line 3-10, as herein provided, as a part of and in conjunction <br />with, other sewer line construction said firms are currently carr;ring out <br />for the City; ani, <br /> <br />iNHEREAS, the submitted quotation price of said contracting firms for the <br />construction of line 3-10 is Eieht Thousand Four Hundred Fifty-Eight Dollars <br />and Sixty-One Cents ($8,458.61) which total price is based on related unit <br />prices in the current line construction by the firms for the City: <br /> <br />NOW, THEREFORE, the parties to this agreement, in consideration of the <br />premises and of the mutual benefits each is to receive, the parties hereto <br />do hereby agree as follows: <br /> <br />The City will forthwith direct and authorize the stated contracting firms <br />of Prillaman & Pace, Incorporated and J. V. Richardson, Corp., to proceed <br />with the construction of line 3-10, as herein provided, pursuant to plans <br />and specifications prepared by said Consulting Engineers and on file with <br />the City; and, all matters relating to said construction shall be under <br />the direct supervision and control of the City, or its agents, and in roamer <br />similar to the current or other projects of like construction in vmich the <br />City may nor or hereafter be engaged. <br /> <br />The construction of said line shall commence at the earliest practical date <br />and shall be proceeded with to completion, without interruption, except for <br />conditions of weather or other circumstances beyond the control of the City <br />or its contractors. <br /> <br />TJuon completion of the line and receipt by the City of statement from the <br />contractors of the cost of construction, the City shall transmit this such <br />statement, or a copy thereof, to Fanier Farms. <br /> <br />
