H. Yeaman, Clerk of the Council, is <br />directed to receive and acknowledge such agreement as presented by Roy C. <br />stone, subject to the agreement having the approval as to form and content <br />by the City Attorney. <br /> <br />,.--. <br /> <br />City Manager Hirst informed Coumil that every effort, without success, has been <br /> <br />made to obtain one-hundred-per-cent participation from the property owners on <br /> <br />Childress Drive tmmrds a shared-cost curb-and-gutter construction project on <br /> <br />Childress Jrive and that, although constituting a varaiance in Council's policy, <br /> <br />construction of said curb-and-gutter in accordance with Council's directive is <br /> <br />now in progress, omitting construction along non-participating properties (see <br /> <br />Council minutes of October 25, 1960). <br /> <br />As a matter of record, Council ordered incorporated in these minutes the following <br /> <br />agreement between Lanier Farm, Inc., ani the City of Martinsville, effecting the <br /> <br />intentions of the parties thereto as recorded in Council's minutes of August 23, <br /> <br />1960 and November 22, 1960, pertaining to the construction of a sewer line on <br /> <br />North Indian Trail to Spruce Street: <br /> <br />LANIER FAIDfS, nCORPORATED <br />FROM: AGREEMENT <br />CITY OF MARTIN3VILIE, VIRGINIA <br /> <br />THIS AGREEMENT, made this 10th day of October, 1960, by and between LANIER <br />FARMS, IN:;., a Virginia Corporation, party of the first part, hereinafter <br />referred to as Lanier Farms, and The CITY OF MARTINSVILLE, Virginia, a <br />Municipal Corporation, party of the second part" hereinafter referred to <br />as the City. <br /> <br />-VI I T N E SSE T H- <br /> <br />THAT VlliEREAS, the City has undertaken a program of sewerage system <br />improvements, the construction of which is planned to extend over a seven- <br />;,{ear period; and, plans for such program are as shovm on a general area <br />plan dated NOvember 28, 1956, as prepared by Wiley & Wilson, Consulting <br />
