<br />22 <br /> <br />FIRDA Y <br /> <br />OCTOBER 28, 1960 <br /> <br />.~- <br /> <br />"HHEREAS there was this day presented to the Council of <br />the City of Martinsville, Virginia, a proposed contract <br />between City of VJ8.rtinsville and the APPALACHIAN P(JJER <br />COt1PANY providing for street lighting, dated <br />as set out in said proposed contract; and <br /> <br />"WHEREA,S tl,e terms and conditions of said proposed contract, <br />with attachment and Addendum thereto, are agreeable and <br />acceptable to Council. <br /> <br />"NOW, THEREFORE, BE IT RESOLVED by the Council of City of <br />Martinsville: <br /> <br />/...-- <br /> <br />"(1) That said contract be and it hereby is apnroved and <br />accepted and that City ~anager Julian F. Hirst be and he <br />hereby is authorized to sign and deliver said contract for <br />and on behalf of City of Martinsville; and <br /> <br />"(2) That W. H. Yeaman be and he hereby is authorized <br />and directed to affix the seal of City of Martinsville to <br />said contract and attest the same." <br /> <br />ADDENDUM NO. 1 <br /> <br />This ten-year contract covering 44 - 4000 lumen incandescent <br />street lights is for street lighting in the area of the City <br />of Martinsville annexed January 1, 1960, wherein the City was <br />required by Court Order to provide street lighting prior to <br />January 1, 1961, and the aforesaid contract may be cancelled <br />without additional cost to the City of Martinsville in the <br />event it acquires from Appalachian Power Company its other <br />facilities within the annexed area. <br /> <br />This contract shall not be construed as, itself, establishing <br />franchise privileges for electric distribution service nor <br />shall it be construed as prejudicial to any claims made by either <br />party in future proceedings relating to the furnishing of electric <br />pOwer in the territory annexed. <br /> <br />By unanimous consent, Council agreed to consider the request of Martinsville <br /> <br />High School government class students for permission to use the City's <br /> <br />automatic voting machines in a "mock election" to be conducted among the <br /> <br />high school students on November 1, 1960. Upon motion, duly seconded, Council <br /> <br />agreed to make one machine available for this election, if it is determined <br />
