<br />.42 <br /> <br />TUESDAY <br /> <br />~H 22, 1960 <br /> <br />Any enclosure in which such a.'limals are kept and maintained <br />pursuant to such permit shall be kept in a clean and sanitary condition <br />to the satisfaction of the director of public health. Manure in which <br />flies breed or are likely to breed is hereby declared to be a nuisance <br />detrimental to public health. The natural presence of fly larvae in <br />manure shall be evidence that flies are breeding there. Any person <br />owning or maintaining arw enclosure for the keeping of such animals <br />or fowl shall comply Yiith such methods and procedures as may be provided <br />by the director of public health or his representative for the control <br />or elimination of flies and rodents. <br /> <br />Any person, firm or corporation now keeping any horse, mule, <br />COllI", chicken, turkey, duck or other like animal or fowl in violation <br />of the limit;:ltions as to distance under the provisions of this Section <br />shall be allowed to contirme to keep such animal or fowl, so long as <br />the keeping is otherwise lawful, subject to the follO'.'ling provisions: <br /> <br />(1) Such person must make application to the director of <br />public health for a non-conforming permit to keep such an <br />animal, such permit to be granted if the director of public <br />health is satisfied that such enclosure in -.'Thich such animal <br />is kept and maintained is in a clean and sanitary condition. <br /> <br />(2) Such applicant shall comply with the provisions of <br />Section 2-4 (c) and (d) hereinafter set forth. <br /> <br />(C) Except as otheTIuse provided in this Ordinance, the <br />director of public health or his representative shall administer this <br />Ordinance, in: luding the receiving of applications for permits, the <br />irnpection of premises and the issuance of permits. No permit of <br />occupancy shall be issued by him unless the applicant complies with the <br />provisions of this Ordinance. <br /> <br />Applications for ei ther a permit of occupancy or a non-conforming <br />permit shall be made upon application forms supplied by the director of <br />public health and shall be accompanied by a fee of One Dollar ($1.00). <br /> <br />In applying for a permit under this section, the applicant <br />thereby authorizes the drrector of public health or his representative <br />to enter upon the premises as often as he deems advisable to determine <br />the sanitary condition of such premises and to determire if the provisions <br />of this section are being violated. <br /> <br />Nothing in this Ordinance shall be construed to eliminate the <br />necessity of compliance with the Building and Zoning Codes of the City of <br />Martinsville. <br /> <br />(d) Failure to obtain a permit from the director of public <br />health or the violation of an; of the provisions of this section as herein- <br />before provided s1121l constitute an unlawful act aYld shall subject the <br />occupant of the premises to punishment as provided by Section 1-6, Chapter I, <br />Part II of this Code, and the nuisance thereby created shall be ordered abated. <br />
