<br />L26 <br /> <br />TUESDAY <br /> <br />FEBRUARY 9. 1960 <br /> <br />(1) Such person must make application to the <br />director of public health for a non-conforming <br />permit to keep such an animal, such permit to be <br />granted if the director of public health is <br />satisfied that such enclosure in which such <br />animal is kept and maintained is in a clean and <br />sanitary condition. <br /> <br />(2) Such applicant shall comply with the provisions <br />of Section 2-4 (c) and (d) hereinafter set forth. <br /> <br />(c) In applying for a permit under paragraph (b) of this <br />section, the applicant thereby authorizes the director of public <br />health or his representative to enter upon the premises as often <br />as he deems advisable to determine the sanitary condition of such <br />premises and to determine if the provisions of this section are <br />being violated. <br /> <br />(d) Failure to obtain a permit from the director of public <br />health or the violation of any of the provisions of this section <br />as hereinbefore provided shall constitute a nuisance and shall <br />subject the occupant of the premises to punishment as provided <br />by Section 1-6, Chapter I, Part II of this Code, and the nuisance <br />thereby created shall be ordered abated. <br /> <br />The permit granted rmder paragraphs (a) and (b) of this <br />Section shall be revocable at any time when, in the sole discretion <br />of the director of public health the provisions of this Section have <br />been seriously violated. <br /> <br />(e) Every public or private zoo for the housing and exhibition <br />of wild animals or fowl must meet the requirements of the director <br />of public health, and a permit must be secured therefor. <br /> <br />The Planning Commission advised that it recormnends the rezoning to "B-1 <br /> <br />Business" that property not already so zoned, identified as formerly the <br /> <br />Mary Love Cobb property located on Broad Street, owned and requested so <br /> <br />rezoned ~ Ms.rtinsville Bulletin and/or Hr. Robert II. Haskell, Jr., Publisher, <br /> <br />owner. Council called for a duly-advertised public hearing to be conducted <br /> <br />on said proposed rezoning at Council's regular meeting scheduled to be held <br /> <br />M<irch 8, 1960. <br /> <br />In response to an inquiry from the Martinsville-Henry County Airport Development <br /> <br />Corporation, Council indicated that the Corporation need not render progress <br /> <br />
