<br />11 <br /> <br />TUESDAY <br /> <br />JANUARY 12. 1960 <br /> <br />Council enthusiastically acknowledged an indication of the support of the program <br /> <br />by the Board of Directors of the Martinsville ~ea Chamber of Commerce. <br /> <br />Under date of January 12, 1960, the Planning Commission recommended that the <br />area annexed to the City as of January 1, 1960 "be zoned A-1 Residential inasmuch <br /> <br />as it is continguous to this zoning classification". Council, thereupon, called <br /> <br />,,--. <br /> <br />for a duly-advertised public hearing on said proposed zoning--the area not being <br /> <br />zoned in any manner while a part of Henry County--to be conducted at Council's <br /> <br />meeting to be held February 9, 1960. Meanwhile, Council received copies of the <br /> <br />materials, as recently prepared b,y City Manager Hirst, and as forwarded on January <br /> <br />6, 1960 to the citizens Ii ving wi thin the area annexed on January 1 st. <br /> <br />In connection with the proposed reconstruction of portions of Routes 57 & 58 <br /> <br />within the City's corporate limits, and being advised that because of a missing <br /> <br />heir one p<'lrcel of land needed for right-of-way can be acquired only through <br /> <br />condemnation proceedings, Council adopted the following resolution authorizing <br /> <br />the instigation of condemnation proceedings and appointing City Attorney Claude E. <br /> <br />Taylor, Jr., to represent the City in this matter: <br /> <br />--- <br /> <br />WHE:REAS, Marvin L. Hill, duly appointed agent for the City of Martinsville, <br />Commonwealth of Virginia, in the matter of purchasing properties required <br />for proposed Route 58 expansion, has reported that he has exhausted all <br />means within the limitations of his authority and ability, without success, <br />toward acquiring that fractional interest of lot D, Sally Earley, "~p of <br />Property of Sally E. Earley Property, East of Martinsville, Virginia," owned <br />~ James Staley, an heir of Sally Earley, who was last heard from in <br />Philadelphia, Pennsylvania, in 1885, the said James Staley having been absent <br />from the City of Martinsville since 1885, and now presumed to be dead; <br />1~''''\- It <br />NC1,.l THEREFORE, be it resolved by the City Council of the City 6} Martinsville, <br />in regular meeting assembled this 12th day of January, 1960'/l-doth hereby appoint <br />Claudl:~ E. Taylor, Jr., as its attorney in this matter and doth authorize the <br />said Glaude E. Taylor, Jr., to conduct and bring condemnation proceedings to <br />acquire of and on behalf of the City of Martinsville, said certain property <br />interE~sts from the said James Staley, his heirs, or unknown heirs-at-law, <br />for the purpose hereinbefore stated. <br />
