<br />90 <br /> <br />TUESDAY <br /> <br />OCTOBER :13, 1959 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, <br />Virginia, with Mayor John W. Shultz presiding, was held in the Council Chamber, <br />City Hall, Tuesday, October :13, 1959, at 6:30 P.M., all members being present, <br />with the exception of C ounc ilman Clarence C. Donavant, viz., Mayor and C ounc il- <br />man John W. Shultz; Vice-Mayor and Councilman E. E. Stone; Councilman Thomas J. <br />Burch; and Councilman J. Frank Wilson. <br /> <br />After the invocation, Council approved as read the minutes of its special <br />meetings held September 17th and 24th, 1959, and of its regular meeting held <br />September 29, 1959. <br /> <br />City Manager Hirst reported that a proposed agreermnt between the City and Mr. <br />J. Ben Davis--carrying out Council's directive of September 29, 1959 for the <br />replacing of a sewer line across Mr. Davis' property outside the corporate <br />limits south of the Hillcrest-Rivermont Court area-has been executed by Mr. <br />Davis, whereupon Council authorized the City Manager to execute said agreement <br />on behalf of the City of Martimville. (Among the provisions of said agreeroont <br />were: (a) Mr. Davis grants to the City a ten-foot wide easement on which no <br />permanent improvement shall ever be constructed; (b) Mr. Davis will re:iJnburse <br />the City for fifty per cent of the cost of replacing the line within ten days <br />after completion; and (c) the City will make available to Mr. Davis a sewer <br />connection at prevailing rates.) <br /> <br />Council continued for further consideration the purchase offer recently submitted <br /> <br /> <br />by Appalachian Power Company for the City's electric utility and, also, City <br /> <br /> <br />Manager Hirst I s report thereon. <br />
