<br />c\,' (,. ) <br />ceO -) <br /> <br />encumbered by it in the installation, construction, or repair of its gas mains or <br /> <br />-- <br /> <br />pipes, to remain open or the public way disturbed or encumbered for a longer <br /> <br />period of time than shall, in the opinion of the director of public works, or other <br /> <br />proper official of the city, be reasonably necessary. In all cases where any such <br /> <br />highltJay or other public place shall be excavated, disturbed or encumbered by the <br /> <br />grantee, the grantee shall take all precautions necessary or proper for the <br /> <br />protection of the public and shall maintain adequate warning signs, barricades, <br /> <br />-- signals, and other devices necessary or proper to adequately give notice and warning <br /> <br />to the public of the existence of all actual conditions present. <br /> <br /> <br />(4) Hhenever the city shall pave or repave any street or shall change the <br /> <br />grade or line of any street or public place or shall construct or reconstruct any <br /> <br />conduit, water main, sewer or water connection, or other municipal public ",orks <br /> <br />or utility, it shall be the duty of the grantee, ",hen so ordered by the city, to <br /> <br />change its mains, services, and other property in the streets or public places at <br /> <br />its own expense so as to conform to the established grade or line of such street <br /> <br />or public place and so as not to interfere with the conduits, sewers, and other <br /> <br />mains as constructed or reconstructed. However, the grantee shall not be required <br /> <br />to relocate pipes, mains and appurtenances when the street, alley, or public <br /> <br />ground, in which they are located, is vacated for the convenience of abutting <br /> <br />property owners and not as an incident to a public improvement, unless the <br /> <br />reasonable cost of such relocation and the loss and expense resulting therefrom <br /> <br />is first paid to the grantee.. <br /> <br />(5) The city may at its discretion assign personnel for inspection or <br /> <br />superYision of excavation and related worl: being performed by the grantee. <br /> <br />- 9 - <br />
