Jurisdiction of Gover~ental Regulatory Commissions. <br />Where any provision of this franchise is in conflict with any lawful rule of <br />the State Corporation Commission of the Conunonvlealth of V:irginia or other <br />constituted body or conunission legalJ.y authorized to prescribe rules govern- <br />ing the conduct of the Grantee, so that the Grantee cannot reasonably comply <br />with both the provisions of this franchise ani the rule of such Commission <br />or body, then the Grantee shall comply 1J'Tith such rule instead of the con- <br />flicting provision of this franchise, but the Grantee shall comply with all <br />of the provisions of this franchise where such can be done without violating <br />valid statutes or rules of the said Commission or other regulatory bod;y". <br /> <br />Section 19. General Ordinances of the~. The rights and <br />privileges herein granted are expressly subject to the conditions, limita- <br />tions and provisions contained in the general_ ordinances of the City in <br />force relative to the use of streets of said City so far as they may be <br />applicable to the rights and privileges herein granted, and to any and all <br />ordinances which may be hereafter passed by the City applicable thereto in <br />the exercise of the police pOV'fer or arry other pmver vested in said City for <br />the regulation of public service corporation using the streets of the City, <br />and the City expressly reserves the right to pass all such reasonable <br />ordinances for the regulation of the use of the streets by the Grantee and <br />the exercise of the rights and privileges herein granted. <br /> <br />Section 20. Franchise Bids. <br />Subsection (a). Advertisenent for Franchise Bids. Upon approval of <br />this Ordinaree by the City Council in the manner prescribed by law, it shall <br />be the duty of the clerk of the council to cause to be advertised once a week <br />for four (4) successive weeks an invitation for bids for the rights, privi- <br />leges and franchises to be granted in any by said proposed Ordinance, copies <br />of which shall be available in the city manager's office for distribution to <br />persons making inquiry. The advertisement shall give notice that the bids are <br />to be in writing and shall be delivered to the office of the city manager of <br />the City not later than 2 P.M., E.S.T., September 8, 1959, which bids shall <br />be opened and then presented by the city manager to the City Council, to be <br />dealt with or acted upon in the manner prescribed by la,.f. Said advertisement <br />shall expressly reserve the right of City Council to reject arw and all bids. <br />Subsection (b). Procedure after receipt of Bids. All bids for the <br />franchise, rights, and privileges to be granted in arw by this Ordinance shall <br />be submitted in writing and each bidder shall file ,.Ii th his bid a bond executed <br />in favor of the City of Martinsville, in the penalty of Ten Thousand Dollars <br />($10,000) with surety and in form satisfactory to the city attorney, and <br />conditioned as follows: <br />1. That is his or its bid is accepted and an Ordinance substantialJ.y in <br />the form aforesaid is passed granting to him or it the franchise, rights, and <br />privileges hereinbefore set forth, then he or it will, wi thin thirty (30) days <br />from and after the approval of the Ordinance making said grant and before the <br />date on which the same shall become effective as herein provided, file a <br />written acceptance of the same with the clerk of the council, in form to be <br />approved by the city attorney. <br />2. That at the sane time that said written acceptance is filed, he or it <br />will execute and file with the clerk of the council a bond as provided for in <br />subsection (c) of Section 14 of the franchise. <br />
