<br />;0 <br /> <br />TUESDAY <br /> <br />AUGUST ll, 1959 <br /> <br />Section 5. Obligation of Grantee to Furnish Natural Gas. <br />Subsection (a). Except to the extent that the Grantee shall be prevented <br />from doing so by order or rules and regulations of the Federal Power <br />Commission or the State Corporation Commission, the Grantee will deliver <br />to and distribute for the use of the inhabitants "\"ithin the City, dUI'i~ <br />the period of this franchise, and providing there is a demand for same, not <br />less than one million, five hundred thousand cubic feet per day of natural <br />gas of the heating value and pressure herein else-where defined unless the <br />Federal Power Commission or other regulatory body having jurisdiction and <br />authority to do so shall reduce the allocation of natural gas to the Grantee <br />for distribution in the City. In the event such allocation is do reduced <br />then the Grantee will deliver to and distribute within the Ci~J for the use <br />of the inhabitants thereof, if and "When demanded, the maximum quantity <br />possible under the reduced or altered circumstances. In the event the <br />Grantee should file or make application to the Federal Power Commission, or <br />other regulatarybody having jurisdiction, for a reduction in allocation of <br />natural gas to the Grantee for distribution in the City, the Grantee shall <br />simultaneously with such filing or application give written notice to the <br />City Council of such action and purpose. <br />Subsection (b). In the event the suppJy of natural gas available, <br />allocable or allocated to the Grantee is increased beyond the amount <br />presently allocated to it under the order of the Federal Power Commission, <br />or other authorized governmental agency, the Grantee shall allocate and <br />distribute to the inhabitants and consumers within the City, each time such <br />available supply is increased, if there is then a demand for more natural <br />gas in the City, a fair ratable share of such increased supply. <br />Subsection (c). The Grantee shall be allmved to mix manufactured gas <br />with natural gas for distribution within the City as such mixture may be <br />advantageous to the operation of the Grantee. Such mixture, however, shall <br />not relieve the Grantee of its obligations under this franchise nor shall <br />it relieve the Grantee of the obligation to make available to the City the <br />volume of natural gas specified in this section. <br />Subsection (d). Should, within the period of this franchise, develop- <br />ments within the field of power or heating substances offer to the Grantee <br />the opport1IDity to mare effectively, efficiently or economicalJy serve its <br />customers through use of a substance or material other than natural gas <br />then the Grantee may petition the City Council for review of this franchise <br />in line with such developments. <br /> <br />Section 6. Service Standards and Controls. <br />Subsection (a). In General. The Grantee agrees to provide and maintain <br />at all times, its entire plant and system in such condition that it vJill <br />furnish safe, adequate, efficient and continuous service. <br />Subsection (b). Quality. The quality of the natural gas to be furnish- <br />ed and supplied by the Grantee to the consumers of natural gas within the <br />City shall at all times be of a heating value of not less than 1,000 British <br />Thermal Units per cubic foot of gas so furnished, lli'1less the Federal Power <br />Commission or other authorized governmental agency should approve a lower <br />value for gas to be delivered to the Grantee by the company or companies <br />transmi tting the natural gas to the Grantee. <br /> <br />
