I 2~SO learned that Mr. <br />Sawyer is unwilling to correct this situation unless formal action is taken. <br /> <br />III. CONTENTION AND PLEA <br /> <br />The existing situation is causing some damage or depreciation to my <br />property. <br /> <br />The cncroachment or obstruction of the Street is a violation or maral <br />principle and is legally wrong. I do not believe this counciling board can <br />afford to harbor, protect, or encourage any person that will encroach upon <br />City property or cause damage to any citizen. <br /> <br />In addition to being Cl. property owner, I am a citizen jn a political <br />sub-division having certain desires regarding maintenance of restrictions <br />and full use of public facilities and right-of-waJ~. <br /> <br />I sincerely hope that this Council will take formal action tonight to <br />cause the removal of the existing fence from the public right-of-way of <br />Zee Street. <br /> <br />I deeply appreciate the hearing you have given me in this matter and <br />want to thank: you kindly far your services. <br /> <br />CITY COUNCIL ffiESENTATION REGARDIMJ. ZEE STREET DEVELOPMENTS <br /> <br />April 14, 1959 <br /> <br />There is probabl;)T no need for me to take the time of this Council <br />since a review of facts relative to the removal of encroacl1.ments and <br />opening the sectio'i1'"'O"f"Zee Street, which extends across Jefferson Circle, <br />was thoroughly considered and agreed upon September 25, 1956. I was <br />assured by City Coum jl (The late Mayor F. V. Woodson) on September 25, <br />1956 that the Street would be freed from encroachments and maintained <br />open for vehicular traffic at all times without a formal hearing for which <br />I had requested on the evening of September 25, 1956. <br /> <br />I appeared befare the Coun::il's farmal session upon the above date <br />and when the City Manager (Julian F. Hirst) reviewed the agenda regarding <br />the re-opening of Zee Street, I was recognized by the Council and made the <br />following statement: <br /> <br />III have discussed the Zee Street problem with each of you, and you <br />have assured me that the obstructions will be moved immediately and. <br />the Street will be maintained open for vehicular traffic at all times. <br />If this action is promptly taken I will be satisfied, othervTise I will <br />expect a place on the agenda some future date for a formal he2..ring. <br /> <br />I was again asslU'ed the Street would be maintained open. <br />
