<br />Section 6. Use of Streets. <br />Subsection a. General Control and Location of Lines. <br /> <br />The grantee I in any opening it shall make in the streets in the city I shall be <br /> <br />ubject to the provisions of this franchise and to all applicable ordinances and regulations. <br /> <br />All poles erected by others in behalf of the grantee shall be neat and symmetrical and shall <br /> <br />be so located as to in no way interfere with the safety or r-:onvenience of persons traveling <br /> <br />on or over the streets and public places. The city reserves the right by resolution or other- <br /> <br />wise to further or specifically designate the locations of any poles I towers I lines, cable <br /> <br />or conduit, with reference to municipal or public utility line or conduit facilities such as <br /> <br />sewer I water, electric, telephone and gas in such a manner as to promote the public safety <br /> <br />and to protect public property. Failure by the city to so designate shall not relieve the <br /> <br />grantee of responsibility in matters of public safety. Such pOles I lines or conduit as may <br /> <br />be constructed or located shall be constructed or located as not to interfere with the <br /> <br />.:onstruction, location and maintenance of lines of municipal utilities or duly franchised or <br /> <br />established public service corporations. Any designation of location required or authorized <br /> <br />herein shall be accomplished by the city so as not to unnecessarily delay the grantee in <br /> <br />any of its operations. The city hereby reserves the right at all times to reject any proposed <br /> <br />installation by or in behalf of the grantee whose manner or place of construction the city <br /> <br />:eems contrary to the provisions of this grant or to public interest, and may order and direct <br /> <br />the grantee or its agent, at its own expense I to move the location or alter the construction <br /> <br />of any existing installation wherever the city council deems the public interest to require <br /> <br />such removal or alteration, having due regard to the equities of the parties concerned and <br /> <br />the purpose of this grant. <br /> <br />Subsection b. Disturbance of Streets--Restoration. <br /> <br />(1) Written permits I in any or all cases I shall be obtained by the grantee <br /> <br />from the director of public works of the city before and whenever it becomes necessary for <br /> <br />the grantee to excavate in the streets of the city in order to install, construct, extend, or <br /> <br />repair any of the antenna television lines or services therein or thereon. Such permits may <br /> <br />applicable to any or all types of excavations. Such permits I further I shall state the <br /> <br />particular part or point of the streets where said construction or excavation is to be made <br /> <br />- 5 - <br />
