<br />Section 24. Effective Date and Franchise Bids. <br /> <br />Subsection a. Effective Date. This ordinance shall be in force from and after the <br /> <br />day of <br /> <br />, 196_, and shall not be published, <br /> <br />Subsection b. Advertisement of Franchise Bids. Upon approval of this ordinance <br /> <br />-I the city council in the manner prescribed by law, it shall be the duty of the clerk of the <br /> <br />council to cause it to be advertised by title once a week for four (4) successive weeks in <br /> <br />the Martinsville Bulletin, and such other newspapers of general circulation as deemed <br /> <br />desirable and to extend invitation for bids for the rights, privileges and franchises to be <br /> <br />granted in and by said proposed ordinance, copies of which shall be available in the city <br /> <br />manager's office for distribution to persons mailing or making personal inquiry. The <br /> <br />advertisement shall notify that the bids are to be in writing and shall be delivered to the <br /> <br />office of the city manager of the city not later than 12 Noon, E.S.T., <br /> <br />1.9 , which bids shall be presented by the city manager to the city council, to be dealt <br /> <br />th or acted upon in the mode prescribed by law. Said advertisement shall expressly reserve <br /> <br />a right of city council to reject any and all bids. <br /> <br />Subsection c. Procedure for Acceptance of Bids. All bids for the franchise, rights, <br /> <br />and privileges to be granted in and by this ordinance shall be submitted in writing and each <br /> <br />bidder shall file with his bid a bond executed in favor of the City of Martinsville, in the <br /> <br />malty of ten thousand dollars, with surety and in form satisfactory to the city attorney, <br /> <br />.d conditions as follows: <br /> <br />(1) That if his or its bid is accepted and an ordinance substantially in the <br /> <br />form aforesaid is passed granting to him or it the franchise, rights, and privileges herein- <br /> <br />before set forth, then he or it will, within thirty days from and after the approval of the <br /> <br />ordinance making said grant and before the date on which the same shall become effective <br /> <br />herein provided, file a written acceptance of the same with the clerk of the council, in <br /> <br />,rm to be approved by the city attorney. <br /> <br />(2) That at the same time that said written acceptance is filed, he or it will <br /> <br />execute and file with the clerk of the council: (a) a bond as provided for in Subsection c of <br /> <br />Section J. 5 of this ordinance; (b) executed copies of pole, tower and conduit attachment and <br /> <br />yse agreements with each utility as prescribed more fully in Section 5 of this ordinance; and, <br /> <br />I evidence of insurance as provided for in Subsection b of Section 15 of this ordinance. <br /> <br />- 16 - <br />
