<br />176 <br /> <br />TUESDAY <br /> <br />NOVEMBER 23, 1965 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-third day of November, <br />1965, that the Zoning Code and Zoning YBp of the City of Martinsville <br />be, and is hereby, amended to reclassify--for zoning purposes--to <br />llC-2 Commercial" that one lot identified as the Ben W. Via property <br />on the west side of Ellsworth Street, adjacent to and south of the <br />south line of an alley between said Ben W. Via property and property <br />owned by the First National Bank of Martinsville & Henry County at <br />the southwest corner of Church and Ellsworth streets. <br /> <br />After receiving a presentation by Mr. James H. Ford, Attorney at Law and <br /> <br />Counsel for local members of the Virginia Electronic Association, in opposition <br /> <br />to certain features of a proposed CATV franchise ordinance and in request of <br /> <br />further delay by Council in acting upon said franchise ordinance, pending the <br /> <br />resolving of certain questions raised by Mr. Ford, Council placed said ordinance, <br /> <br />as revised November 23, 1965, upon first reading. <br /> <br />(S E E <br /> <br />INS E R T) <br /> <br />Council indicated its approval of plans calling for underground installation of all <br /> <br />utility lines and services in Lanier Farm's new subdivision off Sam Lion Trail, <br /> <br />east of Hazelwood Lane, noting that there would be no additional cost upon the <br /> <br />City for its installation of electric lines inasmuch as the developer would bear <br /> <br />the additional cost of underground electric lines vs. the cost of overhead lines. <br /> <br />Council received, and referred to the Planning Commission for its consideration <br /> <br />and reco~~endation, a petition submitted by Mr. W. R. Broaddus, III, Attorney at <br /> <br />Law, on behalf of Appalachian Power Company, requesting the rezoning to "M-2 <br /> <br />Industrialll of seven lots--for which petitioner holds a purchase option and on <br /> <br />which petitioner proposes to construct an electric substation--near Dudley <br /> <br />Street and Northside Drive. <br />
