<br />44 <br /> <br />TUESDAY <br /> <br />AUGUST 24, 1965 <br /> <br />Mr. H. P. Collins, of 1013 Cherokee Trail, by petition and in person, <br /> <br /> <br />requested the construction of curb-and-gutter (on a shared-cost basis) <br /> <br /> <br />along the front of his property on Cherokee Trail, which would be the <br /> <br /> <br />extending of the approved project (for an adjoining property owner) for <br /> <br />a distance of one hundred feet on the north side of Cherokee Trail in <br /> <br /> <br />the direction of Park Court. Upon motion, Council authorized the <br /> <br />construction of this requested curb-and-gutter in conjunction with the <br /> <br />approved projects involving the Giddings and Renfroe properties. <br /> <br />Council was informed that voluntary participation and damage waivers <br /> <br />have been obtained from all owners of property along Cherokee Court <br /> <br />with the exception of Mr. Roy Hodnett, whose side-lot line represents <br /> <br />approximately 18% of the total footage involved in the curb-and-gutter <br /> <br />project approved, by Council for this street. Council was also informed, <br /> <br />however, of Mr. Hodnett's indication that he does not object to the <br /> <br />construction of this curb-and-gutter and, too, that he might assume his <br /> <br />pro-rata share which other property owners have agreed to underwrite, <br /> <br /> <br />although he is unwilling (as yet) to execute the required damage waiver. <br /> <br />Council was also informed that there is a probability that Mr. Hodnett's <br /> <br /> <br />property would not be disturbed during the construction, unless it be <br /> <br />from some dirt spillage onto his property and except for the construction <br /> <br />of a drive-way entrance; whereupon motion, Council authorized the Public <br /> <br />Works Department to proceed with the project as scheduled. <br /> <br />Upon motion, duly seconded and unanimously carried, Council authorized the <br /> <br />executing by appropriate City officials of an agreement with the Norfolk & <br /> <br />Western Railway Company, providing for an overhead City-owned electric power <br /> <br />line crossing of the railway company's right-of-way off Roundabout Road in <br /> <br />the vicinity of the Wray farm. <br />
