<br />398 <br /> <br />TUE'SDAY <br /> <br />MAY 11. 1965 <br /> <br />By letter dated May 10, 1965, the Planning Commission recommended that <br /> <br />the request filed with Council on February 23, 1965--asking for a "P-2 <br /> <br />Professionalll zoning classification for those properties fronting the <br /> <br />north side of East Church Street, between Starling and Oakdale 'Streets, <br /> <br />and subsequently changed to a request (before the Planning Commission) <br /> <br />for a "C-2 Commercial" classification--be denied for the following <br /> <br />reasons: <br /> <br />(1) Were this petition allowed, the change to Commercial zoning <br />would not be indicative of good orderly development of the <br />commercial district inasmuch as the properties in question are <br />not contiguous to any commercial district in the City, but are <br />surrounded by residential uses; (2) there is no substantial <br />evidence of need for commercial zoning in this area; and (3) <br />while there may be some merit in the argument that this is a <br />fringe area of the down-town business district and might possibly <br />be in a state of transition as to zoning, there is no evidence <br />apparent of property deterioration or substandard living <br />conditions in the area. <br /> <br />Subject to deed on conveyance and to satisfactory easement, Council <br /> <br />authorized the widening of the south side of East Church Street, for a <br /> <br />width of fourteen feet, along the frontage on said street of the new <br /> <br />Patrick Henry Mall (or Shopping Center). The deed would convey to the <br /> <br />City ten feet in fee simple and the easement would transfer the Patrick <br /> <br />Henry MallIs lease rights on four feet from the Early Estate along this <br /> <br />frontage, with the City to install pavement and with the Patrick Henry <br /> <br />Mall to replace sidewalk and curb-and-gutter. Meanwhile, Council <br /> <br />suggested that efforts be made to permit extending of this widening to <br /> <br />Brookdale Street. <br /> <br />City Manager Hirst reported that he has received no response to his recent <br /> <br />notices addressed to major industrial and commerical water customers of the <br />
