3E TUESDAY JANUARY 26, 1965 assault-and-battery and other misdemeanors are pending. There being no objection:3 registered to this proposal, Council adopted the following ordinance effecting this amendment to the City Code: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this twenty-sixth day of January, 1965, that the Code of the City of Martinsville, Virgjnia (1956, and as amended), be and is hereby amended by the adding thereto of the following Section 10-35: SECTION 10-35. Dismissal of Prosecution. When a person is in jailor under a recognizance to answer a charge of assault-and-battery or other misdemeanor, or has been indicted for an assault-and-battery or other misdemeanor, for which there is a remedy by civil action, unless the offense was committed by or upon the City Sergeant, any police officer, or officer of justice, or riotously, or with intent to commit a felony, if the part injured appear before the judge or justice who made the commitment or took the recognizance, or before the court in which the indictment or warrant is pending, and acknowledge in writing that he has received satisfaction for the injury, such judge, justice, or court may, in his or its discretion, by an order supersede the commitment, discharge the recognizance, or dismiss the prosecution, upon payment by the defendant of costs accrued to the City of Martinsville or any of its officers. By letter dated January 26, 1965, the Martinsville Planning Commission recommended that a "11.-16 Re;3idential!l zoning classification be applied to all property lying on the south and east sides of Sam Lion Trail as annexed to the City as of January 1, 1965; and that a l1R-9 H.esidential" zoning classification be applied to all property lying on the north and west sides of ~;am Lion Trail as annexed to the City also as of January 1, 1965. In tentatively accepting the Commission's recommendation, Council called for a duly-advertised public hearing to be conducted by Council on this - recommendation at Council's regular meeting scheduled for February 23, 1965.
