There being no <br /> <br />objection:3 registered to this proposal, Council adopted the following <br /> <br />ordinance effecting this amendment to the City Code: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-sixth day of January, 1965, <br />that the Code of the City of Martinsville, Virgjnia (1956, and as <br />amended), be and is hereby amended by the adding thereto of the <br />following Section 10-35: <br /> <br />SECTION 10-35. Dismissal of Prosecution. <br /> <br />When a person is in jailor under a recognizance to answer a <br />charge of assault-and-battery or other misdemeanor, or has <br />been indicted for an assault-and-battery or other misdemeanor, <br />for which there is a remedy by civil action, unless the offense <br />was committed by or upon the City Sergeant, any police officer, <br />or officer of justice, or riotously, or with intent to commit <br />a felony, if the part injured appear before the judge or <br />justice who made the commitment or took the recognizance, or <br />before the court in which the indictment or warrant is pending, <br />and acknowledge in writing that he has received satisfaction <br />for the injury, such judge, justice, or court may, in his or <br />its discretion, by an order supersede the commitment, discharge <br />the recognizance, or dismiss the prosecution, upon payment by <br />the defendant of costs accrued to the City of Martinsville or <br />any of its officers. <br /> <br />By letter dated January 26, 1965, the Martinsville Planning Commission <br /> <br />recommended that a "11.-16 Re;3idential!l zoning classification be applied <br /> <br />to all property lying on the south and east sides of Sam Lion Trail <br /> <br />as annexed to the City as of January 1, 1965; and that a l1R-9 H.esidential" <br /> <br />zoning classification be applied to all property lying on the north and west <br /> <br />sides of ~;am Lion Trail as annexed to the City also as of January 1, 1965. <br /> <br />In tentatively accepting the Commission's recommendation, Council called for <br /> <br />a duly-advertised public hearing to be conducted by Council on this <br /> <br />- <br /> <br />recommendation at Council's regular meeting scheduled for February 23, 1965. <br />
