<br />upon the City Sergeant, any police officer, or officer of justice, or
<br />riotously, or with intent to commit a felony, if the party injured
<br />appear before the judge or justice who made the commitment or took
<br />the recognizance, or before the court in which the indictment or
<br />warrant is pending, and acknowledge in writing that he has received
<br />satisfaction for the injury, such judge, justice, or court may, in
<br />his or its discretion, by an order supersede the commitment,
<br />discharge the recognizance, or dismiss the prosecution, upon payment
<br />by the defendant of costs accrued to the City of Martinsville or any
<br />of its officers.

<br />A representative of Lynchburg Concrete Pipe Products Company appeared before
<br />
<br />Council and urged Council to specify the use of concrete pipe in this project,
<br />
<br />inasmuch as sources of other types of pipe are located outside of the State of
<br />
<br />Virginia whereas the petitioner's product is manufactured in Virginia; however,
<br />
<br />upon the recommendation of Wiley & wilson, Consulting Engineers, Council
<br />
<br />specified the use of vitrified clay pipe and awarded the construction contract
<br />
<br />to Laramore Construction Company, low bidder.
<br />
<br />Under date of January 12, 1965, City Manager Hirst presented requested information
<br />
<br />to Council, covering the capital outlay program which was defeated in the bond
<br />
<br />referendum held October 20, 1964, and ways and means of proceeding with this
<br />
<br />program by financing same from "current" but increased taxation. City Manager
<br />
<br />Hirst proposed that--if Council proceeds with the program and the increases in
