<br />requesting the closing and vacating of those portions of 1tE1t, 1tFrr, 1tG1t, and
<br />
<br />1tH1t 'Streets as located on the East side of the Norfolk & Western Railway
<br />
<br />Company's right-of-way, a duly-constituted Board of Viewers reported (in
<br />
<br />writing) that it has viewed the streets named in amended petition and
<br />
<br />that, in its opinion, no inconvenience to the public generally would result
<br />
<br />from the discontinuance and abandonment of said streets and, further,
<br />
<br />reported its belief that the discontinuance and abandonment and vacating of
<br />
<br />said streets would be to the best interest of the city. The Planning
<br />
<br />Commission also reported in writing that it recommends that said portions
<br />
<br />of 1tF", "G", and 1tH1t Streets be abandoned with the City retaining such
<br />
<br />easement for utilities as it deems necessary and that the Council authorize
<br />
<br />a study of a location for a new thoroughfare, extending from Memorial
<br />
<br />Boulevard near the Norfolk & Western Railway underpass, down the hollow
<br />
<br />adjacent to Mr. Aaron's property and terminating at duFont Road. In
<br />
<br />accepting these reports, Council unanimously adopted the following resolution
<br />
<br />of vacation and abandonment:

<br />WHEREkS, it appearing that in the subdivision of certain realty
<br />situated in the City of Martinsville, Virginia, certain areas
<br />were designated for street and road purposes, among which are
<br />"F1t, 1tG1t, and "R1t Streets; and,
<br />
<br />WHEREAS, it appearing that said streets have never been opened
<br />and used as such and that the said City Council has heretofore
<br />appointed viewers to ascertain if the public would suffer any
<br />inconvenience by the abandonment of said 1tF1t, 1tG1t, and 1tR"
<br />'Streets; and,
<br />
<br />~REkS, the said viewers have reported in writing that they
<br />find no inconvenience would be suffered by the public of the
<br />City of Martinsville by the vacation and abandonment of "F",
<br />1tG1t, and 1tH" 'Streets on the East side of the Norfolk & Western
<br />Railway Company; and
<br />
<br />WHEREAS, it appearing to the Council that all of the necessary
<br />requirements prescribed by Section 15.1-364 of the Code of Virginia
<br />of 1950, as amended, for the vacation and abandonment of the said
<br />"F1t, 1tG1t, and 1tW' 'Streets, have been duly complied with;
