<br />28 <br /> <br />TUESDAY <br /> <br />JANUARY 28, 1964 <br /> <br />The property owner requests the stipulation that if the right-of-way <br />was not used within a period of five years it would be b.ought back <br />from the City at the same price. This reversion can be broken into <br />two sections. If the section from Church to Mineral were not used <br />in its entirety, then undoubtedly the section beyond the railroad <br />would not be used and the entire right-of-way would be sold back. <br />If the City were to widen to the full width from Church to Mineral <br />but were not to widen from the railroad to the Lester Lumber Company <br />property within the five-year period, then the City would be obligated <br />to sell back that section from the railroad northward for the amount <br />of $5,000. <br /> <br />The City does not have appropriated funds for this purpose in its <br />current budget and it would be reccmmended that if the transaction <br />is acceptable to the City Council that the purchase price be advanced <br />out of the 1964-65 b'.ldget and that funds be provided in that budget <br />for this purpose. <br /> <br />With the availability of right-of-way, Lester Street and its extension <br />would serve as an integral part of the overall thoroughfare plan. <br /> <br />Mr. Brown does not wish to release just one block or a portion of this overall <br />proposal but advises that he would negotiate only on the entire proposition. <br />It would appear if the Council wished to involve itself in this street <br />project that it should acquire the entire right-of-way offer. No schedule <br />is currently suggested as to when work on any of this would be proposed a2 <br />such a schedule would be forthcoming dependent upon Council's approach to <br />the overall thoroughfare recommendation last submitted and the availability <br />of funds in future budgets. <br /> <br />At the request of Mr. Douglas K. Frith, Attorney at Law and counsel for the heirs <br /> <br />of the Sallie A. Earley Estate, Council continued a petition submitted by the <br /> <br />Earley Estate, requesting the closing and vacating of an alley bordering the <br /> <br />Earley Estate property located near the intersection of East Church Street and <br /> <br />Brookdale Road. <br /> <br />In acknowledging the presence of students of Mr. George Seagraves' Martinsville <br /> <br />High School government classes, Council discussed with Mr. Seagraves some of the <br /> <br />traffic conditions and hazards in the general area of the intersection of Starling <br /> <br />and Forest Streets, as cited by Mr. Seagraves, indicating that some remedial <br /> <br />measures can be effected in the near future. <br /> <br />Council was adjourned. <br /> <br />W.
