1~ TUESDAY MARCH 12, 1963 ,,.- Enclosed is copy of Order entered by Judge H02ker on March 7, 1963, appointing a Board of Equa_ization for the City of Martinsville. - This Order recites that such appointment was made by virtue of Section 58-895 of the Code of Virginia of 1950, as amended. However, this Section, in my opinion, confers no such authority. A careful reading of this Section of the Code shows that only corporation or hustings courts of each City of mC:c'e than 12,000 population, with the exception of the City of Roanoke, shall in the year of 1950 and every fourth year thereafter appoint such a Board. It does not confer such authority upon a City Circuit Court. I discussed this with Judge Hooker and he agceed wiLh me, but was of the opinion that such E<~1. appointment by him would be sustained. I am sending a copy of this letter to Senator Stone with the thought that he might think it wise to propose an amendment to this Section of the Code. The only companion Section I am able to find is Section 58-895.1. VIRGINIA: IN THE CIRCUIT COURT OF THE CITY OF MARTINSVILLE RE: Board of Equalization for the City of Ma-~'cinsvi lle -- This day came the Council of the City of Martinsville, by its City Attorney, and requested the Court to appoint five members to a Board. of Equal:zation in accordance with Section 58-895 of the Code of Virginia of 1950. The Council of said City having suggested to the Court th2 names of Emmett A. Stover, Clarence C. Donavant, J. Robert Walker, J. E. Zentmeyer and J. E. Jones, but it having been indicated to the Court that J. E. Jones desires not to be re-appointed and the neme of Whitney Shumato having been suggested to the Court in his stead, the Court doth appoint Emmett A. S cover, Clarence C. Donavant, J. Robert Walker, J. E. Zentmeyer and Whitney Shumate, who shall have all authority conferred upon them by Chapter 19 of the Code of Virginia of 1950, as amended, and who shall hold office until June 30, 1963, in accordance with Sectioe 58-899 of the Code of Virginia of 1950, as amended.
