;4 II-umSDAY AUGUST ;30. 196,g Upon recoI'mnendation of CitJ Attorney Cubine, Council adopted the following resolution incorporating in Council's annexation ordinance of Yay 4, 1962, a revised or additional map requested by the annexation court in connection with the City's annexation suit currently before said court: WHE:P..EAS, on the Lith day of 1. ray , 1962, a..'Y1 ordinance was adopted by the Council of the City of 11a.rtinsville, Virginia, ordaining that the City proceed to annex a portion of Her.ry County; and, i~IEP~AS, the map which was filed as a portion of said ordinance referred to in Paragraph 5 thereof was found 'bJ the Annexation Court to be inadequate in that it does not clearly ShOl'[ the present and projected uses of the land to be ar~exed; and, UJlEPw~AS, the Court directed that said map be ar.lended or an additional map, preferably multi-colored, be filed; and, 1..JHE:REAS, such a map has nmT been prepared by Wiley and i-Tilson, Consulting Engineers of Ilfnchburg, Virginia, showing in color the present and projected uses of the land in the area to be annexed, and the Annexation Court having ruled that it was not n8cessary to republish the map since the public had her8tofore had a1rouate notice as required in the Code of VirginiD.: NO-l, THEREFCRE, BE IT RESOLVED b;}r the Council of the City of }~tinsville, Virginia, in re~llar meeting assembled August 30, 1962, that said add:Ltional map, in multi-colors, prepared by Hiley and vIilson, Consulting Engineers, filed with the Clerk of the Circuit Court of Henr:r County, Virginia, on the 30th day of July, 1962, be, and the same is hereby made, a part of the annexation ordirillnce dated the 4th day of May, 1962, as if the same had been filed originally as provided in Paragraph 5 of said ordinance.
