<br />. <br />iI <br /> <br />TUESDAY <br /> <br />MAY 8, 1962 <br /> <br />Upon request of the Norfolk & Western Rai:m~ Company, Council rescinded its <br /> <br />action and the resolution adopted thereby during its special meeting held <br />May 1, 1962, and adopted the following replacement resolution assuring the <br /> <br />Norfolk & Western Railway Company of access right-of-w~ for industrial rail <br /> <br />facilities on the City's airport tract: <br /> <br />,~ <br /> <br />WHEREAS, the City Council of the City of Martinsville, hereinafter <br />referred to as City, during a special meeting of the Council held May <br />1, 1962, by separate Resolution, has made certain coniitional commit- <br />ments in connection with the proposed industrial development of its <br />property known as the "airp ort tractfl; ani, <br /> <br />WHEREAS, the Council has been advised that the Norfolk & Western <br />Railwa;y- Company, hereinafter referred to as Company, desires to con- <br />str'J.ct rail facilities into this prop3rty, for the purpose of serving <br />industrial sites on the pr ope ri?r , if the property is industrially <br />developed; ani, <br /> <br />WHEREAS, it is necessary that all of the "airport tract", except for <br />that portion now reserved as airstrip area, be developed for indust- <br />rial purposes in order to make it economically feasible for the <br />Company to construct industrial lead tracks to serve any plant which <br />might locate on the property and require rail siding facilities: <br /> <br />...,.........,..." <br /> <br />NO\V', THEREFORE, BE IT RESOLVED by the Council of the City of <br />Martinsville, Virginia, in regular neeti~ this 8th day of May, 1962, <br />that it does herein and hereby agree to make its property known as <br />the "airport tractfl available for industrial purposes, sueh industrial <br />property being generally as shown on Drawing I-DlO-l, dated April 12, <br />1962, as prepared by the Company arxl, in the event the Company des :ires <br />to construct and will construct rail facilities to serve industrial <br />custcmers within the property, the City will deed, with fee simple <br />title ani without cost or consideration, to the Company rights-of-way <br />for industrial lead tracks, subject to the following general <br />conditions : <br /> <br />Such rights-of-way shall be a minimum of twenty (20) feet in <br />width together with right of slope fer cuts and fills and shall <br />be generally located as shown on said Drawing I-DlO-l, dated <br />April 12, 1962, as prepared by the Company, with final location <br />of these rights-of-way to be determined by mutual agreement of <br />the CompaI\Y and the City and by survey to be made by the Company. <br /> <br />The conveyance by the City of rights-of-way and the construction <br />of tracks by the Company shall be in accordance with the develop- <br />ment schedule of the property, rather than it being incmnbent <br />upon either party that total conveyance and/or total construe tion <br />be consummated or undertaken at one tine. <br />
