. iI TUESDAY MAY 8, 1962 Upon request of the Norfolk & Western Rai:m~ Company, Council rescinded its action and the resolution adopted thereby during its special meeting held May 1, 1962, and adopted the following replacement resolution assuring the Norfolk & Western Railway Company of access right-of-w~ for industrial rail facilities on the City's airport tract: ,~ WHEREAS, the City Council of the City of Martinsville, hereinafter referred to as City, during a special meeting of the Council held May 1, 1962, by separate Resolution, has made certain coniitional commit- ments in connection with the proposed industrial development of its property known as the "airp ort tractfl; ani, WHEREAS, the Council has been advised that the Norfolk & Western Railwa;y- Company, hereinafter referred to as Company, desires to con- str'J.ct rail facilities into this prop3rty, for the purpose of serving industrial sites on the pr ope ri?r , if the property is industrially developed; ani, WHEREAS, it is necessary that all of the "airport tract", except for that portion now reserved as airstrip area, be developed for indust- rial purposes in order to make it economically feasible for the Company to construct industrial lead tracks to serve any plant which might locate on the property and require rail siding facilities: ...,.........,..." NO\V', THEREFORE, BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular neeti~ this 8th day of May, 1962, that it does herein and hereby agree to make its property known as the "airport tractfl available for industrial purposes, sueh industrial property being generally as shown on Drawing I-DlO-l, dated April 12, 1962, as prepared by the Company arxl, in the event the Company des :ires to construct and will construct rail facilities to serve industrial custcmers within the property, the City will deed, with fee simple title ani without cost or consideration, to the Company rights-of-way for industrial lead tracks, subject to the following general conditions : Such rights-of-way shall be a minimum of twenty (20) feet in width together with right of slope fer cuts and fills and shall be generally located as shown on said Drawing I-DlO-l, dated April 12, 1962, as prepared by the Company, with final location of these rights-of-way to be determined by mutual agreement of the CompaI\Y and the City and by survey to be made by the Company. The conveyance by the City of rights-of-way and the construction of tracks by the Company shall be in accordance with the develop- ment schedule of the property, rather than it being incmnbent upon either party that total conveyance and/or total construe tion be consummated or undertaken at one tine.
