<br />I <br />~ <br /> <br />FRIDAY <br /> <br />M4Y 4. 19~ <br /> <br />- <br /> <br />this situation, it is necessary for the proper protection of <br />the health and safety of those living within the present <br />limits of the City and of persons living within the annexation <br />area that they be brought under the health rules and sanitary <br />regulations of the City in order to afford proper protection <br />for the health of such persons and to afford greater protection <br />to the property and lives of such persons under the improved <br />and more effective fire and pollce protection that the City <br />will afford. Such annexation will likewise afford better edu- <br />cational opportunities and improved school facilities to the <br />school population of the annexation area. <br /> <br />~- <br /> <br />(f) The people living in the annexation area have their <br />commercial, social, recreational, civic, church and other in- <br />terests largely within the City of Martinsville and require <br />daily use of the City streets and other public facilities. <br />Their interest and welfare are identical with the interest and <br />welfare of the residents of the City. .As a result the annexa- <br />tion areas constitute, with the present City, one homogeneous <br />community which can be more completely, efficiently, and <br />economically governed, administered, and serviced with a <br />fair distribution of cost by being under and a part of the <br />same local government to be accomplished through the proposed <br />annexation. <br /> <br />(g) Iarge portions of the annexation area are not served <br />by sanitary sewers but are dependent upon septic tanks. <br />Those portions which are served by sanitary sewers are de- <br />pendent upon the City of Martinsville for the use of its sewage <br />disposal. In addition, large portions of the annexation <br />area are dependent upon the water system operated and maintained <br />by the City of Martinsville. Inequities and inequalities as to <br />rates and charges exist as a result of these conditions. <br /> <br />(h) The greater part of the territory proposed to be annexed <br />is dependent on the City for water, and it is of vital interest <br />to the residents therein and for the development thereof that <br />the City's water distribution system be enlarged, extended and <br />adequately maintained in order to afford an ample and safe supply <br />of water in the territory' proposed to be annexed, for all <br />purposes. <br /> <br />4. The general statement of the terms and conditions upon which <br />the City of Martinsville desires to annex the aforesaid territory <br />and the provisions planned for the future improvement of the <br />annexed territory are as follows: <br /> <br />- <br /> <br />(a) The City of Martinsville shall assmne such just proportion <br />of any existing debt of fenry County or any district or authority <br />therein as may be ordered by the Court and shall pay to H3nry County <br />a sum, payable on the effective date of annexation to compensate <br />the County property for the value, at the time of annexation, of <br />its public improvements in the annexation area; and further to <br />compensate the County in not more than five annual installments <br />
